Planning conditions
  1. Condition 9: Partially Discharged Prior to the commencement of the development or any associated site clearance, a Construction Management Plan (CMP) for each phase, as identified on the approved phasing plan secured under condition 5, shall be submitted to and approved in writing by the Local Planning Authority. The CMP shall include the following: a) A scheme for the monitoring, reporting and control of construction noise and vibration including hours of working and scope for remedial action. b) A scheme for the control of dust and scope for remedial action in the event that dust is identified as an issue or any complaints are received. c) A scheme of chassis and wheel cleaning for all construction vehicles to include the details of the location and specification of a fully working jetted drive-thru bath type wheel wash system together with hard surfacing laid between the apparatus and public highway in either concrete or tarmacadam, to be maintained free of mud, slurry and any other form of contamination whilst in use. A contingency plan including if necessary the temporary cessation of all construction operations to be implemented in the event that the approved vehicle cleaning scheme fails to be effective for any reason. d) Haul routes to the site and hours of delivery. e) Measures to ensure that vehicles can access the site upon arrival so there is no queuing on the public highway. f) Details of site compounds, storage area and contractor and visitor parking. g) Details of the site enclosure or part thereof and gated site security. h) Confirmation that tree protection measures are in place. i) Confirmation that any demolition/construction will be carried out in accordance with the ecological management plan/method statement. j) A scheme for dealing with complaints. k) Details of any temporary lighting which must not directly light the public highway. The CMP shall thereafter be adhered to throughout the relevant period of construction. Reason: In the interests of highway safety and residential amenity in accordance with Policies LP13 and LP17 of the Peterborough Local Plan (2019). This is a precommencement condition because the details to be approved are required to be put in place before development commences for the duration of the development. Plans and documents submitted in support of the discharge of C9: Construction Management Plan Rev D Wheel Wash Specifications - L195 Public comments: During the course of the application, a number of public comments have been received. This highlighted that the CMP does not include the details on the public right of way from Thorney Road into the site or the security measures for retaining the PROW at all times or the IDB drain. In addition, it was raised that the CMP does not provide the details on this pathway as per the s106 schedules and therefore does not comply with LP40. The application is to solely provide details of the construction Management Plan and the highway works on Eyebury Road, therefore the details of the pathway between Thorney Road and the site is not required and the CMP is not looking to discharge that section of the development. Policy LP40 has been addressed through the outline consent and subsequent reserved matters for this parcel. Whilst the developers wish to secure the site, any matters relating to the right of way will need to be managed under separate legislation. Furthermore, concern was raised regarding the hours of construction, due to congestion during peak times, not just school times and noise impact from starting at 07:30 and finishing at 18:00 with generators running. Construction hours will be assessed based on residential amenity and any potential constraints within the area, such as the close proximity of the school. Comments sought highway cleaning in both directions of Eyebury Road and concerns with the wheel wash bath being installed after 6 months. There is limited area for parking on site, this should be expanded and not located adjacent to the care facility. Vehicles should not park off site and deliveries should not be taken adjacent to the care home. Parking is provided in all compounds and is considered appropriate for the scale of the site. The compound to the front of the site is for a temporary period only and considered necessary in that location to enable site access and to build the permanent compound, also mitigating mud on the road. The school needs urgently expanding and the school construction traffic should use the northern access. This is not a matter for consideration by the LPA under this application. Missing locations of tree protection fencing and lighting. This detail was subsequently provided. Finally, one comment provided a full list of comments from the outline consent and outlining their status. This has been noted, but this application only is considering Condition 9 & Condition 25. Eye Parish Council raised an objection to the development due to site levels, surface water drainage and foul water drainage, however these are not matters subject to this application. The objection also referred to the construction management plan and the formation of zebra crossing must be undertaken prior to the first occupation of the site. Assessment: The condition seeks for the following details to be demonstrated within the document: a) A scheme for the monitoring, reporting and control of construction noise and vibration including hours of working and scope for remedial action. Within Section 4 of the CMP is the process for monitoring and managing construction noise, in particular the procedural processes should complaints or issues arise. The hours of operation are: Monday to Friday – 07:30 to 18:00 (no deliveries during 08:00 – 09:00 and 15:00 – 16:00) Saturday – 08:00 to 13:00. There shall be no activity or deliveries on Sundays, Public and Bank Holidays. Any work outside these normal hours will be subject to obtaining prior consent from the Local Authority. The operational hours are acceptable, with the exclusion of school drop-off and pick-up noted. Whilst the school may have further clubs beyond the school day, the significant proportion of movements will be at the key start and finish times for the school day and therefore this has been taken into account with construction hours. Officers note the concerns regarding the proposed start and finish times, however these would be considered reasonable construction times and the use of generators will be for a temporary period only. b) A scheme for the control of dust and scope for remedial action in the event that dust is identified as an issue or any complaints are received. The CMP includes a scheme for the control of dust & dirt from construction activities on the site. c) A scheme of chassis and wheel cleaning for all construction vehicles to include the details of the location and specification of a fully working jetted drive-thru bath type wheel wash system together with hard surfacing laid between the apparatus and public highway in either concrete or tarmacadam, to be maintained free of mud, slurry and any other form of contamination whilst in use. A contingency plan including if necessary the temporary cessation of all construction operations to be implemented in the event that the approved vehicle cleaning scheme fails to be effective for any reason. Wheel washing locations are at the temporary access entrance and then the main access onto Eyebury Road, there are also points indicated throughout the site. The drive through bath wheel wash system will move along the Primary Road as the build out of the development progresses, next locations denoted by number in the star as shown in Appendix C. Eyebury Road will be checked on daily basis by the developers. A road sweeper with road washing capabilities will be arranged as and when necessary to keep the roads as clear as possible from mud deposits emanating from the site. d) Haul routes to the site and hours of delivery. Appendix B confirms the route in which the developers will promote construction traffic to take when visiting and leaving the site. The construction hours include an exclusion for deliveries between 08:00 – 09:00 and 15:00 – 16:00. e) Measures to ensure that vehicles can access the site upon arrival so there is no queuing on the public highway. It is appreciated that the access into the site has to be constructed, therefore during this process a temporary access is required. The existing field access to the south-west corner will be utilised until the 30th September 2026. This access will then be removed and construction access will be taken from the main site access following the completion of the S278 works. It has been confirmed that all delivery vehicles will enter the site and no vehicles will be waiting on the highway to unload deliveries. In particular the temporary compound has a length of circa 70m and the formal compound for Phases 1/2/3 has a waiting area of 50m. it is advised this is sufficient for circa 3-4 articulated lorries to park up to wait on site. f) Details of site compounds, storage area and contractor and visitor parking. Appendix C of the CMP illustrates a site wide plan. Illustrating the locations of compounds, including details such as parking, material storage and site offices. Initially there will be a temporary compound to the front of the site, to allow for access and site set up for the formal compound. This temporary compound (identified as P.C Welfare & P.C Park on Appendix C) shall only be present on site until 31st October 2026. From this point the central compound will be utilised for Phases 1/2/3 and then compound to the eastern boundary, will be utilised for the completion of Phases 3, along with 4 & 5. g) Details of the site enclosure or part thereof and gated site security. Appendix C illustrates a fencing line surrounding the boundary of the site. Furthermore, Site gates will be implemented at the main access in use and will remain open during the indicated construction hours to allow access for all vehicles. h) Confirmation that tree protection measures are in place. The CMP outlines that the requirements of the Arboricultural Report will be followed and trees retained will be protected with the Heras fencing as per the locations on Appendix C. The Tree Officer initially raised an objection due to tree protection fencing not being shown and typo’s within the document. This has since been resolved and Appendix C illustrates the Heras fencing to protect the trees and the CMP references compliance with the Arboricultural Report. Following this no objection was raised. i) Confirmation that any demolition/construction will be carried out in accordance with the ecological management plan/method statement. The CMP confirms under Section 8, that all work will be carried out in accordance with the ecological management plan. j) A scheme for dealing with complaints. Section 2 of the CMP outlines a procedure for complaints, contact details and how these will be processed/recorded. This is satisfactory. Furthermore, Appendix D provides a complaints form and register. k) Details of any temporary lighting which must not directly light the public highway. Lighting has been confirmed at the site compounds (this is not to include the temporary compound – P.C Welfare/P.C Parking). Lighting will include locations such as on the changing room and entrance to the site cabin. All lighting will be projecting away from northerly neighbouring properties. A maximum of 4 lights will be used within the compounds. Appendix E provides a specification for the lighting. Hours of operation for the lighting will be adhere to the construction hours. Monday to Friday – 07:30 to 18:00 Saturday – 08:00 to 13:00 The CMP advises it ‘will be reviewed every 12 months or following any significant change to work activities or updated legislation.’ However, it should be noted this is not a requirement of the planning condition nor the LPA. Any review undertaken of the document is by the developer and should they wish to revise any of the matters in the document, then this will require a formal discharge of the condition. Environmental Health raised no concerns. The document has been reviewed by the Local Highway Authority, within initially an objection raised due wording of the document. Following a revision these matters have been resolved and clarity has been received on the temporary access and compound. Conclusion: The details submitted relating to condition 9 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition for this parcel of land. Condition 9 is hereby partially discharged, subject to implementation in accordance with the approved details.
  2. Condition 25: Discharged Prior to commencement of development, further details of the works to Eyebury Road and a timetable for its implementation, in accordance with the principles set out on EYE-BWBGEN-XX-DR-TR-100-S2 P7 and EYE-BWB-GEN-XX-DR-TR-102-S2 P3, and in LTN 1/20, shall be submitted to and approved in writing by the Local Planning Authority. No dwelling on the development shall be occupied until all of the works have been completed in accordance with the approved details. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019). This is a pre-commencement condition because the offsite highway works are required to make the development acceptable and in addition to planning approval will require separate approval from the Highway Authority under the Highways Act. Plans and documents submitted in support of the discharge of C25: C25 Timetable - L195 Revised Location Plan - ST3716200D Plan 1 Section 278_38 Extent of Works Plan 2 Agreement Plan ST3716808D Revised Proposed Combined Section 278 and 38 Works Extent of Works ST3716801F Public Comments: During the course of the application, a number of public comments have been received. These have been addressed below. The plans for C25 do not include the details on the public right of way from Thorney Road into the site as per the s106 schedules and therefore does not comply with LP40. The application is to solely provide details of the works to Eyebury Road and a timetable for its implementation, therefore the details of the pathway between Thorney Road and the site is not required at this stage. Policy LP40 has been addressed through the outline consent and subsequent reserved matters for this parcel. The entrance would mean removal of two of the current traffic calming measures. All the of works on Eyebury Road should be undertaken before any work starts on the site. The new traffic calming island is to the front of the driveway for No.61 Eyebury Road. Initially public the comments raised an objection to the new speed activate signed is located outside No 67 Eyebury Rd on the grass as the sign location is on a long sweeping blind left bend and questioned visibility. Further comments questioned the removal of the sign. In addition, a question was raised on manhole location and utilities. Details such as signage locations and manholes are reviewed through the highway technical approval process, which is separate to the planning application. Public comments questioned the new layout for the traffic calming islands has the road Give Way line marking on the West side of the road for both islands, should the give way markings before the island nearest the site entrance be on that East side of the road? If not is there enough vehicle swept path room for these Give Way marking as the swept path analysis drawing does not show enough room? Highway markings is reviewed by the Local Highway Authority and through the highway technical approval process. The comments raised concern no foul water connection is shown on the plans. However, this is not subject to this application. Finally, one comment provided a full list of comments from the outline consent and outlining their status. This has been noted, but this application only is considering Condition 9 & Condition 25. Eye Parish Council raised an objection to the development due to site levels, surface water drainage and foul water drainage, however these are not matters subject to this application. The objection also referred to the construction management plan and the formation of zebra crossing must be undertaken prior to the first occupation of the site. The plans illustrate a zebra crossing and the condition illustrates that no dwelling can be occupied until the works have been completed. Assessment: The application has been supported by a number of drawings. The condition seeks further details of the Eyebury Road works in accordance with the outline layout plan. The developer has submitted highly detailed and technical specifications with this condition, the LPA will leave the determination of these to the Highway Technical Approval process and does not wish to duplicate the purpose of other legislation. The condition seeks to ensure an update design is supplied and this has been complied with under drawing 'Revised Proposed Combined Section 278 and 38 Works Extent of Works ST3716801F'. Furthermore, in accordance with C25 Timetable - L195, it is confirmed that the S278 works on Eyebury Road will be implemented prior to the 30th September 2026. Whilst it is noted the public comments sought for these works to be completed before any development on the site begins, the LPA are satisfied that groundworks/construction can occur alongside these works and the timescale given is suitable. The condition requires all these works to be completed before the first occupation regardless. The Local Highway Authority initially raised an objection to C25, given differing versions of drawings that has been received under the Highway Technical Approval process. Following receipt of the updated drawings this illustrates the site access and new traffic calming measures (not forward of resident's driveways) to Eyebury Road. The Local Highway Authority recommended the plans submitted are considered to meet the requirements of condition C25 and hence are acceptable to the LHA in order to discharge this condition. The drawings submitted will require a full assessment through the Highways Act 1980 Section 278 process prior to legal consent to amend the highway. Conclusion: The details submitted relating to condition 25 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 25 is hereby discharged, subject to implementation in accordance with the approved details.
