Planning conditions
  1. Only C3 (soft landscaping) and C8 (temp facilities) require discharging. All other conditions are compliance conditions and are required to be complied with in perpetuity.
  2. Condition 3 (soft Landscaping) Notwithstanding the submitted plans, the development hereby permitted shall not be occupied unless and until a scheme for the soft landscaping of the site has been submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the following:-- Planting plans should include at least 1 tree details of species and size. The soft landscaping shall be carried out within the first available planting season following first occupation or alternatively in accordance with a timetable for landscape implementation which has been approved as part of the submitted landscape scheme. Any trees, shrubs or hedges forming part of the approved landscaping scheme (except those contained in enclosed rear gardens to individual dwellings) that die, are removed or become diseased within five years of the implementation of the landscaping scheme shall be replaced during the next available planting season by the developers, or their successors in title with an equivalent size, number and species to those being replaced. Any replacement trees, shrubs or hedgerows dying within five years of planting shall themselves be replaced with an equivalent size, number and species. Reason: In the interests of visual amenity and enhancement of biodiversity in accordance with Policies LP16 and LP28 of the Peterborough Local Plan (2019). Plans and documents submitted in support of the discharge of C3: - Proposed Site Layout - Condition Details - 0495-26-CC02 Assessment: Having reviewed the submitted plan, the Officer agrees with Tree officer that the proposed details are unfortunately unacceptable and are not in line with the Council's Local Plan policy LP28. The revised information still lacks sufficient details. The trees/shrubs/plants specified within the Planting Schedule need to be clearly identified to the plants/symbols on the plan. Currently, there are only four trees specified on the Schedule, but seven trees on the plan but it has not been indicated which tree is what, and which shrubs are what. Details should also be provided with specifications for planting, care, maintenance, support and protection, including canes/guards/fencing, whatever is consider appropriate/suitable, given the setting/aesthetics of the site, and all tree planting to comply with BS8545:2014 Trees: from nursery to independence in the landscape. As such, the detail submitted is deemed insufficient for the Local Planning Authority to discharge the condition. Conclusion: The details submitted relating to condition 3 are deemed insufficient to the Local Planning Authority and do not comply with the submission requirements of the condition. Condition 3 is not discharged.
  3. C8 - Temporary Facilities Prior to commencement of development, details of the temporary facilities that shall be provided. Details should include location for the storage of materials clear of the highway, facilities for the parking/turning/loading/unloading of all vehicles visiting the site during the period of construction. The details shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of highway safety and in accordance with Policy LP13 of the Peterborough Local Plan (2019) and the NPPF 2024. This is a pre-commencement condition as the temporary facilities needs to be in place before works start on site. Plans and documents submitted in support of the discharge of C8: - Proposed Site Layout - Condition Details - 0495-26-CC02 Assessment: Having reviewed the submitted plan, the Officer agrees with Local Highways Authority that the proposed details are acceptable and are in line with the Council's Local Plan policy LP13. The submitted information shows areas for storage of materials and facilities for vehicles to ensure the highway would not be obstructed during construction. Additional information has also been provided in relation to compliance condition C9 for the wheel washing facilities. As such, the detail submitted is deemed acceptable for the Local Planning Authority to discharge this condition. Conclusion: The details submitted relating to condition 8 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 8 is hereby discharged, subject to implementation in accordance with the approved details.
