Under Section 96A of the Town and Country Planning Act 1990 (as amended), the alterations to Condition 26 are acceptable as non-material amendments to the development approved under planning reference 23/00423/FUL. The amendments vary the original C26 which limited the development above slab level for Buildings 1 and 2 until the redevelopment of the Mill is not complete. The Applicant has justified the variation of this condition to allow for an efficient building process, whilst also ensuring that key building interventions (steels, roof, window/doors etc) are complete on the Mill alongside the development of the new buildings to ensure that the Mill is redeveloped in a timely manner without adversely impacting the viability of the proposed development. Accordingly, Condition 26 of planning permission reference 23/00423/FUL is therefore updated to read as below. This notice shall be appended to planning permission 23/00423/FUL and all other conditions attached thereto remain in place and in force.
The proposed development shall be carried out in strict accordance with the following phasing: - The development of Building 2 shall not continue above Level 00 FFL until the internal steel structure has been installed inside the Mill - The development of Building 1 shall not continue beyond Level 00 FFL until the Mill has the new roof structure complete as per the approved plans - The development of Building 2 shall not achieve completion until the Mill is watertight with completed roof and all windows installed/reinstated as per the approved plans - The development of Building 1 shall not achieve completion prior to the full completion of all required work on the Mill and the Mill achieves completion For the purposes of the above 'completion' shall be defined as a Building Regulations Completion Certificate being issued. The Building numbers are set out in drawing 'Location Plan and Site Masterplan as Proposed' AP0003 Revision P11. Reason: In order to ensure that the locally listed Mill building is renovated to a standard where it can be brought back into use, in the interests of enhancing a valuable local heritage asset in accordance with Policy LP19 of the Peterborough Local Plan (2019).
