The proposal as submitted was not in accordance with local and national planning policy. The local planning authority have worked with the applicant in a positive and proactive manner based on seeking solutions to problems arising in relation to dealing with the planning application. Amendments were discussed and agreed with the applicant to bring the proposal into compliance with policy, and the application can therefore be approved in accordance with Paragraph 38 of the National Planning Policy Framework (2024).
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
The materials to be used in the construction of the external surfaces of the development hereby approved shall be in accordance with the Application Form dated 29th January 2026. Reason: To ensure a satisfactory external appearance, in accordance with Policy LP16 of the Peterborough Local Plan (2019) and Chapter 12 of the NPPF (2024).
The development shall be completed in accordance with the following approved plans: - Site Location Plan, ref: F015- DR-001 Rev A - Proposed Block Plan, ref: F015-DR-050 Rev B - Proposed Ground Floor Layout, ref: F015-DR-150 Rev C - Proposed Site Layout, ref: F015-DR-052 Rev E - Proposed New Overhead Crane, ref: F015-DR-400 Rev A - Proposed Elevations, ref: F015-DR-250 Rev A Reason: To define the permission and for the avoidance of doubt.
The development hereby permitted shall not begin unless and until a biodiversity net gain plan has been submitted to and agreed in writing with by the Local Planning Authority which biodiversity net gain plan shall address the following matters: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat, (b) the pre-development biodiversity value of the onsite habitat, (c) the post-development biodiversity value of the onsite habitat, (d) any registered offsite biodiversity gain allocated to the development and the biodiversity value of that gain in relation to the development, (e) any biodiversity credits purchased for the development, and (f) such other matters as the Secretary of State may by regulations specify. Thereafter, the development shall be carried out in accordance with the agreed approved details. Reason: In accordance with the requirements of Schedule 14, Part 1 of paragraph 14 of the Environment Act 2021 and Policy LP28 of the Peterborough Local Plan (2019) and NPPF (2024).
Prior to the occupation of the development hereby permitted, a Strategic Water Resources Strategy shall be submitted to and approved in writing by the Local Planning Authority. The Strategy shall: a) Demonstrate that adequate non domestic water supply is available to serve the development; and b) Incorporate innovative measures to reduce overall water demand across the site. The development shall thereafter be carried out in accordance with the approved Strategy. Reason: To ensure that the development does not place undue pressure on the existing domestic water supply network, to safeguard water resources, and to secure sustainable water management practices, in accordance with policy LP32 of the Peterborough Local Plan (2019) and the NPPF (2024).
Notwithstanding the submitted details, prior to the occupation of the development a scheme for soft landscaping of the site shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the following:- - Proposed finished ground and building slab levels - Planting plans including retained trees, species, numbers, size and density of planting - Proposed planting plans including trees, species, numbers, size and density The soft landscaping shall be carried out within the first available planting season following completion of the development or first occupation (whichever is the sooner) or alternatively in accordance with a timetable for landscape implementation which has been approved as part of the submitted landscape scheme. Development shall be carried out in accordance with the submitted details. Any trees, shrubs or hedges forming part of the approved landscaping scheme that die, are removed or become diseased within five years of the implementation of the landscaping scheme shall be replaced during the next available planting season by the developers, or their successors in title with an equivalent size, number and species to those being replaced. Any replacement trees, shrubs or hedgerows dying within five years of planting shall themselves be replaced with an equivalent size, number and species. Reason: In the interests of visual amenity of the area and the enhancement of biodiversity, in accordance with Policies LP16, LP28 and LP29 of the Peterborough Local Plan (2019) and Chapter 15 of the NPPF (2024).
Prior to the first occupation of the development a full travel plan shall be submitted to and approved in writing by the Local Planning Authority. The travel plan shall be written in accordance with current industry best practice including guidance of the Department of Transport and the Travel Plans chapter of the PHS Transport Assessment Guidelines. The development shall thereafter be occupied / operated in accordance with the approved travel plan or a plan as subsequently modified and approved in writing by the Local Planning Authority. Reason: In the interests of promoting sustainable transport to, from and within the development, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraphs 116-118 of the National Planning Policy Framework 2024.
Prior to the first occupation or commencement of use, details of an enclosed and secure cycle shelter to accommodate cycles (including non standard cycles at 5% of total cycle parking provision) shall be submitted and agreed in writing with the Local Planning Authority. This area shall thereafter be retained for the purposes of cycle parking in connection with the development in perpetuity. Reason: In the interests of highway safety and to encourage travel by sustainable modes, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraph 116 and 117 of the National Planning Policy Framework 2024.
Notwithstanding the provisions of Class H, Part 7, Schedule 2, of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revising, revoking and re-enacting that Order with or without modification), no enlargement by way of extension, installation of a mezzanine floor or other alteration to any building the subject of this permission shall be carried out without express planning permission first being obtained from the Local Planning Authority upon an application made for that purpose. No unit shall be sub divided into smaller units. Reason: To ensure that sufficient car parking is provided in accordance with Policy LP13 of the Adopted Peterborough Local Plan (2019) and Paragraph 116 of the National Planning Policy Framework 2024.
The office floorspace hereby permitted shall not be occupied at any time other than for purposes ancillary to the Uses Classes E(g)(iii) / B8 use of the unit within which it falls and shall not be independently occupied or used for any other use falling within Use Class E of the Town and Country Planning (Use Classes) Order 1987 (as amended). Reason: To ensure that sufficient car parking is provided in accordance with Policy LP13 of the Adopted Peterborough Local Plan (2019) and Paragraph 116 of the National Planning Policy Framework 2024.
Prior to the first occupation or commencement of use the area shown for the purposes a) of loading / unloading; b) of parking / turning so that vehicles may enter/leave in a forward gear; shall be provided in accordance with drawing ‘Proposed Site Layout, ref: F015-DR-052 Rev E’. Such provision shall thereafter be retained for this purpose and not put to any other use. Reason: In the interests of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraph 116 of the National Planning Policy Framework 2024.
No more than 5,842 sqm of the building shall be used for Use Class B2, no more than 1,200sqm shall be used for Use Class B8, and no more than 844 sqm shall be used for ancillary office purposes. Trade counters are not permitted unless planning permission is first obtained from the Local Planning Authority. Reason: To ensure that sufficient car parking is provided in accordance with Policy Lp13 of the Adopted Peterborough Local Plan (2019) and NPPF (2024).
