Prior to the commencement of development details of existing and proposed site levels including the finished floor levels shall be submitted to and approved in writing by the Local Planning Authority. The plans shall include details of all finished floor levels, levels for associated garages and gardens, details of any earthworks, retaining features and confirmation that level access can be achieved. The development shall thereafter be carried out in accordance with the approved details. Reason: In the interests of visual and residential amenity in accordance with Policies LP16 and LP17 of the Peterborough Local Plan (2019).
Under Section 96A of the Town and Country Planning Act 1990, the proposed amendment to alter the trigger of Condition 13 to pre-commencement, is considered acceptable as a non-material amendment to the development approved under reference 19/00836/OUT. Assessment: The amendment seeks to alter the submission trigger for the site levels conditions which currently seeks details with the submission of the reserved matters and the application seeks to alter the trigger to prior to the commencement of development. This will allow for the re-submission of the site levels, should these details alter as a result of outstanding pre-commencement conditions on the outline consent. The condition wording would alter to the following: ''Prior to the commencement of development details of existing and proposed site levels including the finished floor levels shall be submitted to and approved in writing by the Local Planning Authority. The plans shall include details of all finished floor levels, levels for associated garages and gardens, details of any earthworks, retaining features and confirmation that level access can be achieved. The development shall thereafter be carried out in accordance with the approved details.'' Conclusion: The amendment does not materially alter the requirement of the condition or the information which would be recieved and is acceptable as a non-material amendment. Accordingly, the trigger of Condition 13 of the original permission (ref. 19/00836/OUT) is amended. This decision notice should be read in conjunction with and appended to that for approval 19/00836/OUT and relevant reserved matters and discharge of condition decision notices. All other conditions attached to the approval remain in force and in place.
