Planning conditions
  1. C3: Prior to installation, occupation and use a glazing scheme shall be submitted to and approved in writing by the Local Planning Authority. Where overheating is an issue, the scheme shall be developed in accordance with the Approved Doc O and where appropriate the Acoustic Ventilation and Overheating Residential Design Guide. Thereafter the development shall be implemented in accordance with the approved details, prior to the occupation of any unit to which it relates and shall thereafter be retained and maintained as such in perpetuity. Reason: To safeguard the future occupier amenity of the residential flats, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and the National Planning Policy Framework (2024). Plans and documents submitted in support of the discharge of C3: - Elevations as Existing and Proposed (Drawing Number:BB36/2D). - Plans as Proposed (Drawing Number: BB36CD/1). - Specification: 4 FT (16 Argon 90) 4 FT (16 Argon 90) 4FT [Standard Aluminium] (Received: 28.01.26). Assessment: Having reviewed the submitted documentation, Officer have identified concerns. The acoustic report states that glazing needs to provide 32dB sound insulation, but the proposed glazing only provides 27dB. Therefore, this does not meet the requirements. The higher level is required because of night time noise at the front and ktichen extract noise to the rear. The report does allow for lower performance glazing at the rear if the kitchen extract noise is reduced. However, this has not been demonstrated. As such, the details submitted are not acceptable to the Local Planning Authority and conditon 3 cannot be discharged. Conclusion: The details submitted relating to condition 3 are not acceptable to the Local Planning Authority and fail to comply with the submission requirements of the condition.
  2. C4: Prior to installation occupation and use, a scheme which specifies the provisions for alternative ventilation of the development shall be submitted to and approved in writing by the local planning authority. Where appropriate the scheme shall comply with Approved Document F, Approved Doc O, and the Acoustic Ventilation and Overheating Residential Design Guide for design and acoustic specification purposes. Thereafter the development shall be implemented in accordance with the approved details, prior to the occupation of any unit to which it relates and shall thereafter be retained and maintained as such in perpetuity. Reason: To safeguard the future occupier amenity of the residential flats, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and the National Planning Policy Framework (2024). Plans and documents submitted in support of the discharge of C4: - Elevations as Existing and Proposed (Drawing Number:BB36/2D). - Plans as Proposed (Drawing Number: BB36CD/1). - Brink Sonari (Received 28.01.26). - Sonair 3 Specificaiton (Received 28.01.26). Assessment: Having reviewed the submitted documentation, Officer have identified concerns. The submission suggests that windows must always stay closed to meet noise limits, therefore an alternative ventilation system is required and overheating must be properly addressed. As the rear faces onto extract equipment for the ground floor restaurant opening windows cannot be relied on and the risk of overheating is high. The applicant has no sufficently addressed issues of overheating. Approved Document O requires dynamic thermal modelling where windows cannot be opended with the use of alternative mitigation. As such, the details submitted are not acceptable to the Local Planning Authority and conditon 4 cannot be discharged. Conclusion: The details submitted relating to condition 4 are not acceptable to the Local Planning Authority and fail to comply with the submission requirements of the condition.
