Planning conditions
  1. Condition 4: No development, excluding demolition, shall take place until details of works to Fengate, to amend the existing site access, and provide access for cyclists have been submitted to and approved in writing by the Local Planning Authority. The development shall not be occupied/brought into use until all of the works have been completed in accordance with the approved details. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019). This is a pre-commencement condition because the off site highway works are required to make the development acceptable and in addition to planning approval will require permission from the Highway Authority under the Highways Act. Plans and documents submitted in support of the discharge of C4: Plans: 9000- 003 rev P2 External works ( Sheet 1 of 2) lans: 9000- 004 rev P2 External works ( Sheet 2 of 2) Plans: 25174- 1301- rev P1 Plan 2- Extent of works Plans: 25174- 1300- rev P1 Plan 1- Location Plan Assessment: On drawing 9000-003 P2 External Works Sheet 1 of 2, the Applicant has indicated that a raised table will be provided at the access with the pedestrian crossing on this raised section with tactile paving either side of the junction. The raised table is shown with a cross fall of 1:45 into the site and then a 1:15 gradient is provided into the site for the ramp. However, the raised table is directly adjacent to the Fengate with no ramp details shown in this direction. In order for Officers to determine the acceptability of the ramp, Officers needs to review the cross fall, kerb upstands and spot levels on the road/ramp. This information is required at this stage, as it may result in the pedestrian crossing needing to be relocated further south into the site, to ensure an appropriate ramp can be constructed. Within the proposed design it illustrated the pedestrian crossing directly abutting Fengate with flush kerb around the radii. This could result in vehicles overrunning the tactile paving as they are not protected by a full-height kerb around the radii. Currently onsite the pedestrian crossing is marginally offset. This will prevent vehicles overrunning the tactile paved area. The LHA note that on Application 22/01699/FUL, the drawings indicated a dropped kerb for cycleway access, to enable cyclists to enter the cycle way at this location. This has not been replicated onto the drawings submitted under these applications, but will be expected on future revisions. Conclusion: The details submitted relating to condition 4 are insufficient to satisfy the submission requirements of the condition. Therefore, Condition 4 is NOT discharged.
  2. Condition 11: No development, excluding demolition, shall take place until a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment has been submitted to and approved in writing by the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, an appraisal of remedial options, and proposal of the preferred option(s), and a timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation. Reason: To ensure the proposed remediation plan is appropriate and in order to protect human health and controlled waters, in accordance with Policy LP33 of the Peterborough Local Plan (2019) and paragraph 189 of the National Planning Policy Framework (2023). This is a pre-commencement condition because contamination must be adequately remediated prior to construction works taking place to prevent risks of pollution during the ground works and construction process. Plans and documents submitted in support of the discharge of C11: - Phase 2 Ground Investigation 22.08.027a - Discovery Strategy 22.08.027b-f01 Assessment: After reviewing the submitted documents with regard to C11 (remediation scheme), the Discovery Strategy is accepted by this department, however, there is insufficient information regarding remediation to discharge this condition. A remediation scheme is necessary. The previously submitted Phase 2 report classified the site as characteristic situation CS-2, therefore Ground gas protection measures are necessary which should be addressed in the awaited remediation scheme. Additionally, should unsuspected contamination be identified, as discussed in the Discovery Strategy, further remedial works may be necessary. Conclusion: The details submitted relating to condition 11 are insufficient and the condition is NOT discharged.
  3. Condition 14: No works, except demolition, shall takes place until a detailed surface water drainage scheme for the site, based on sustainable drainage principles and an assessment of the hydrological and hydro geological context of the development, has been submitted to and approved in writing by the local planning authority. The scheme should include but not be limited to: o Demonstrate that all storage features can half empty within 24 hours for the 1 in 30 plus. In case the half drain down time is more than 24 hours then demonstrate that features can accommodate a 1 in 10-year storm events within 24 hours of a 1 in 30-year event plus climate change. o Provide detailed engineering drawings of each component of the drainage scheme. o Demonstrate the appropriate level of treatment for all runoff leaving the site, in line with the Simple Index Approach in chapter 26 of the CIRIA SuDS Manual C753. o Provide engineering site layout of the proposed drainage network at the site. This should include the following details: manholes cover levels, invert levels, pipes dimensions, slopes, tank cover and invert levels both at inlet and outlets, outflow manholes and pipes levels, and top water level in the attenuation tank during 100year plus 40percent CC allowance. o Provide a drainage plan which details exceedance and conveyance routes, FFL and ground levels. o Provide an updated written report summarising the final strategy and highlighting any minor changes to the approved strategy. The scheme shall subsequently be implemented prior to occupation. Reason: To prevent flooding by ensuring the satisfactory storage of/disposal of surface water from the site, to ensure the effective operation of SuDS features over the lifetime of the development and to provide mitigation of any environmental harm which may be caused to the local water environment, in accordance with Condition LP32 of the Peterborough Local Plan (2019). Plans and documents submitted in support of the discharge of C14: Plans: 25174- 1300- rev P1 Plan 1- Location Plan Plans: 9000- 000 rev P2 Drainage Strategy Plans: 9000- 001 rev P2 Detailed drainage ( Sheet 1 of 2) Plans: 9000- 002 rev P2 Detailed drainage ( Sheet 2 of 2) Plans: 9000- 006 rev P2 Drainage Details Plans: 9000- 005 rev P2 Exceedance Flow Assessment: Condition C14 sought for discharge under this application relates to Condition C14 of the full application only. Based on the submission, there is insufficient information for the Lead Local Flood Authority (LLFA) to determine the suitability of the proposed draiange strategy. The LLFA note that full drainage calculations have not been provided to support the proposed drainage strategy. The Applicant should submit the full drainage calculations to demonstrate the suitability of the proposed strategy. Furthermore, the LLFA raise concersn on how water will be attenuated or access the proposed system, such as downpipes not connecting to the proposed system. The exceedance flow drawing indicates an area of flooding from IC-0006-S and IC-0007-S within the 1 in 100 year +40% climate change event of 9.7m3. The Officer has questioned why the permable pacing hasn't been increased in depth to attenuate the 1 in 100 year +40% climate change event to prevent ground flooding. The plans indicate that the existing culvert is to be removed along the southern boundary of the site and existing ditch will be extended. Whilst the LLFA welcome the removal of culverts, the LLFA have concerns regarding the position of the new proposed head wall and outfall from the hydro brake at IC-0017-S. The Applicant should consider how they will physically build this area with a culvert/head wall on an angle and the outfall from IC-0017-S being directly alongside the headwall. The LLFA require a cross section of the existing ditch to be provided, details of the existing culvert and dimensions of the ditch which is being extended. No information has been provided as to how this ditch will connect to the land to the east, please confirm if any works are being proposed to the east. Conclusion: The details submitted relating to condition 14 are insufficient and therefore Condition 14 is NOT discharged.
