Reason: In order to protect and safeguard the amenities of the area, in accordance with Policies LP16 and LP29 of the Peterborough Local Plan (2019). PCC Tree Officer notes that there is no objection to the Discharge of the condition subject to satisfactory implementation. Condition 12 (Construction environmental management plan) NOT DISCHARGED No development shall take place until and unless a Construction Environment Management Plan, including, but not necessarily limited to, the measures to protect Dogsthorpe Star Pit as set out at 5.6 of the Environmental statement, has been submitted to, and approved in writing by, the Local Planning Authority. The development shall thereafter be carried out in complete accordance with the approved CEMP. Reason: In the interests of the conservation and enhancement of biodiversity, in accordance with Policy LP28 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework 2021. This is a pre-commencement condition because the ecological management scheme will be an integral part of the development including during the construction works. Submitted Documents: Constructional environmental management plan Assessment: This condition was imposed in the interests of conserving and enhancing biodiversity in accordance with Policy LP28 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework (2021). The aim of the condition is to ensure that construction activities are undertaken with full regard to the ecological sensitivities of the site, including the proximity of Dogsthorpe Star Pit and the requirements set out in Section 5.6 of the Environmental Statement. PCC Wildlife Officers have reviewed the submitted Construction Environmental Management Plan (CEMP) and have raised concerns that, while the document makes extensive reference to the role of the Ecological Clerk of Works (ECoW), it does not provide sufficient procedural detail to ensure compliance with key ecological safeguards when the ECoW is not present on site. In particular, the Wildlife Officer notes that the CEMP does not set out clear mechanisms for contacting the ECoW in urgent situations nor does it provide contractors with adequate information regarding the requirements arising from Protected Species Licences. This omission could pose a significant risk to compliance. Furthermore, the CEMP does not include several essential components needed to demonstrate that adequate biodiversity protection measures will be in place during construction. These include the incorporation of the mitigation requirements in Section 5.6 of the Environmental Statement, reference to and explanation of relevant Protected Species Licence conditions, identification and protection of donor and receptor sites for translocated species, mapping of Biodiversity Protection Zones, and provision of ECoW contact details for use when the ECoW is off-site. Officers have reviewed the concerns raised and agree that the CEMP, in its current form, does not provide adequate clarity or procedural safeguards to ensure the required ecological protections can be implemented effectively throughout the construction phase. As such, Officers do not consider the submitted document to be sufficient to discharge the condition at this stage. Conclusion: As such, the Condition 12 of permission 20/00508/FUL is NOT discharged.
