C10 - Soil Verification Prior to the occupation of the first dwelling within each development parcel / village or part there of or first public use of the land (whichever is the sooner) which has been the subject of capping in accordance with the approved soil and capping reports Sub-soil capping, chemistry and thickness report (Dec 2015), a phasing plan shall be submitted to and approved in writing by the Local Planning Authority which shows the build out phases (or sub phases) across the parcel/village. Prior to the occupation of the first dwelling within each of those phases (or sub phases) or first public use of the land a report shall be submitted to and approved in writing by the Local Planning Authority which demonstrates that the top soil meets appropriate standards and is free from contamination. This shall be based upon the requirements set out in condition 9 and confirm compliance with this. The development shall thereafter be carried out in accordance with the approved details prior to the occupation of the first dwelling within that phase (or sub phase) or first public use of the land. Reason: In the interests of public safety and amenity in accordance with the provisions of the National Planning Policy Framework and policy PP20 of the Planning Policies DPD. Plans and documents submitted in support of the discharge of C10: - Clean Capping Validation Report - Hampton Wood topsoil report - GeoMatters Email (Mark Lewis) - 252320-01 01 Ashton Road Oundle Ph2 Assessment: Information in the form of a report is required to demonstrate that the topsoil meets appropriate standards and is free from contamination is required. It is noted from the applicant that this application only covers plots 270 – 323 and 351 – 358 (of Parcel R10, Hampton Woods) as set out in the report. Having reviewed the submitted reports and information, the Officer agrees with the Council's Pollution control Officer that the proposed details are acceptable and are in line with the Council's Local Plan. As such, the detail submitted is deemed acceptable for the Local Planning Authority to discharge the condition. Conclusion: The details submitted relating to condition 10 within plots 270 – 323 and 351 – 358 are deemed acceptable to the Local Planning Authority and comply with the submission requirements of the condition. Condition 10 is hereby partially discharged for plots 270 – 323 and 351 – 358, subject to implementation in accordance with the approved details.
