Highways Act 1980 - Section 148, Sub-Section C It is an offence to deposit anything including building materials or debris on a highway which may cause interruption to any user of the highway (including footways). In the event that a person is found guilty of this offence, a penalty may be imposed in the form of a fine. It is the responsibility of the developer and contractor(s) to ensure that no building materials or debris are placed on or remain within the highway during or after the construction period.
Highways Act 1980 - Section 149 If anything is so deposited on a highway as to constitute a nuisance, the Local Planning Authority may by notice require the person who deposited it there to remove it forthwith and if he fails to comply the Local Planning Authority may make a complaint to a Magistrates Court for a Removal and Disposal Order under this Section. In the event that the deposit is considered to constitute a danger, the Local Planning Authority may remove the deposit forthwith and recover reasonable expenses from the person who made the deposit. It is the responsibility of the developer and contractor(s) to ensure that no building materials or debris are placed on or remain within the highway during or after the construction period.
The proposal as submitted is in accordance with local and national planning policy and has been approved without amendment, in accordance with Paragraph 39 of the National Planning Policy Framework (2024). Therefore, there was no need for the local authority to work with the applicant to seek solutions to problems arising in relation to dealing with the application.
Subject to the imposition of the attached conditions, the proposal is acceptable having been assessed in the light of all material considerations, including weighing against relevant policies of the development plan.
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
The materials to be used in the construction of the external surfaces of the development hereby approved shall be in accordance with drawings 'Proposed Site Elevations 22084/04' & 'Proposed Elevations 25057/05'. Reason: To ensure a satisfactory external appearance, in accordance with Policy LP16 of the Peterborough Local Plan (2019) and Chapter 12 of the National Planning Policy Framework (2024).
The development shall be completed in accordance with the following approved plans: - Location Plan (Drawing Number: 25057/01, Rev P2) - Proposed Block Plan (Drawing Number: 25057/02) - Proposed Site Plan (Drawing Number: 25057/03) - Proposed Site Elevations (Drawing Number: 22084/04) - Proposed Elevations (Drawing Number: 25057/05) Reason: To define the permission and for the avoidance of doubt.
Prior to the commencement of the relevant part of the development, details of the surface water drainage connection shall be submitted to and approved in writing by the Local Planning Authority. The development shall not connect directly into the existing, silted gullypot. The connection must be made via an oblique connection directly onto the gully lateral pipe to ensure a free-flowing, self-cleansing system. The works shall be carried out in strict accordance with the approved details. Reason: To ensure an appropriate and effective drainage connection in accordance with LP32 of the Peterborough Local Plan (2019) and the NPPF (2024).
The lighting attached to the 6m lighting columns shall not exceed the obtrusive light limits specified for environmental zone E3 in the Institution of Lighting Professionals document ''Guidance Note 01:21, The Reduction of Obtrusive Light''. Reason: In order to protect and safeguard the amenity of the area and neighbouring residents, in accordance with Policy LP17 of the Peterborough Local Plan (2019) and paragraph 187(e) of the National Planning Policy Framework (2024).
No development shall take place until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. The Construction Management Plan shall include but not be limited to the following:- a) A scheme of chassis and wheel cleaning for all construction vehicles to include the details of location and specification of the system, together with hard surfacing laid between the apparatus and public highway in either concrete or tarmacadam, to be maintained free of mud, slurry and any other form of debris whilst in use. A contingency plan including if necessary the temporary cessation of all construction operations to be implemented in the event that the approved vehicle cleaning scheme fails to be effective for any reason. b) Haul routes to the site c) Hours of delivery. d) Banksman to ensure that vehicles can access the site upon arrival to ensure that there is no queuing on the public highway. e) Details of site compounds, storage area and contractor and visitor parking. f) Details of any temporary lighting which must not directly light the public highway. The development shall thereafter be carried out in accordance with the approved Construction Traffic Management Plan. Reason: In the interests of highway safety in accordance with Policy LP17 of the Peterborough Local Plan 2019 and Paragraph 115 of the National Planning Policy Framework 2024. This is a pre-commencement condition as the CMP needs to be in place before works start on site.
