  1. Subject to the imposition of the attached conditions, the proposal is not acceptable having been assessed in the light of all material considerations, including weighing against relevant policies of the development plan.
  2. Insufficient information has been submitted to demonstrate that the proposed would protect the amenity of neighbouring occupiers or future residents, contrary to Policy LP17 of the Peterborough Local Plan (2019) and the NPPF (2024). ). No technical details have been provided for the proposed extraction and ventilation system. As a result, the applicant has failed to demonstrate that noise, vibration, odour and fumes associated with the takeaway, particularly given the proposed operating hours until 01:00am, would not result in unacceptable harm to the nearby residential properties. Furthermore, the extraction flue would be positioned immediatley adjacnet to a habitable room window of flat 2, at first floor level, with no evidence submitted to show that future occupiers would be adequaltey protected from noise, odour, or pollution arising from the commercial use below. Accordingly, the proposal fails to demonstrate acceptable amentiy standards for both existing neighbouring occupiers and future residents and therefore conflicts with Policy LP17 of the Peterborough Local Plan (2019) and the provisions of the NPPF (2024).
