The proposal as submitted was not in accordance with local and national planning policy. The local planning authority have worked with the applicant in a positive and proactive manner based on seeking solutions to problems arising in relation to dealing with the planning application. Amendments were discussed and agreed with the applicant to bring the proposal into compliance with policy, and the application can therefore be approved in accordance with Paragraph 38 of the National Planning Policy Framework (2024).
Subject to the imposition of the attached conditions, the proposal is acceptable having been assessed in the light of all material considerations, including weighing against relevant policies of the development plan.
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
The development hereby permitted shall be carried out in accordance with the following plans: -Location Plan -Proposed Block Plan 02 Rev B -Proposed Floor Plans and Elevation 04 Reason: For the avoidance of doubt and in the interests of proper planning.
The materials and colours to be used in the construction of the proposed development hereby permitted shall match those identified within the submitted Application Form (received 03.12.2025) and the submitted plan 'Proposed Block Plan' 02 Rev B (received 04.02.2026). Reason: For the Local Planning Authority to ensure a satisfactory external appearance, in accordance with Policy LP16 and 19 of the Peterborough Local Plan (2019) and Sections 12 and 16 of the National Planning Policy Framework (2024)(2025 as amended).
No development or other operations shall commence on site in connection with the development hereby approved, (including any tree felling, tree pruning, demolition works, soil moving, temporary access construction and or widening, or any operations involving the use of motorised vehicles or construction machinery) until a detailed Arboricultural Impact Assessment, including an Arboricultural Method Statement and Tree Protection Plan, has been submitted to and approved in writing by the Local Planning Authority. No development or other operations shall take place except in complete accordance with the approved documentation. Such statements shall include full detail of the following: - Implementation, supervision and monitoring of the approved Tree Protection Scheme - Implementation, supervision and monitoring of the approved Tree work Specification - Implementation, supervision and monitoring of all approved construction works within any area designated as being fenced off or otherwise protected in the approved Tree Protection Scheme. - Timing and phasing of Arboricultural works in relation to the approved development. Reason: In order to protect and safeguard the amenities of the area, in accordance with Policies LP16, 19 and LP29 of the Peterborough Local Plan (2019) and Sections 15 and 16 of the National Planning Policy Framework (2024)(2025 as amended). This is a pre-commencement condition because the approved construction specification must be in place and adequate prior to development commencing to ensure the trees are protected.
Prior to the first occupation or commencement of use of the proposed access, pedestrian visibility splays shall be provided on both sides of the access. The splays shall measure 1.5 metres x 1.5 metres, measured up the side of the access and along the back edge of the highway from where the access joins the public highway. The visibility splays shall thereafter be retained and kept permanently clear of all obstacles above 600mm in height. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraph 115 of the National Planning Policy Framework (2024)(2025 as amended).
Prior to occupation or the commencement of the use of the proposed access and parking area, the parking and turning shall be provided to enable vehicles to enter, turn and leave the site in forward gear and park clear of the public highway. The area shall be delivered in accordance with submitted plan 'Proposed Block Plan' 02 Rev B and thereafter retained for that specific use in perpetuity. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraph 115 of the National Planning Policy Framework 2024.
Any gates or other means of enclosure provided across the vehicular access shall be set back a minimum of 6 metres from the edge of the public highway where it adjoins the site. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Paragraph 115 of the National Planning Policy Framework (2024)(2025 as amended).
No trees, shrubs, or hedges within the site which are shown as being retained on the approved plans shall be felled, uprooted, willfully damaged or destroyed, cut back in any way or removed without the prior consent of the Local Planning Authority. Any trees, shrubs, or hedges removed without such consent, or which die or become severely damaged or seriously diseased wihtin 5 years from the completion of the development hereby permitted shall be replaced with trees, shrubs or hedge plants of similar size and species unless the Local Planning Authority give written consent to any variation. Reason: In order to protect and safeguard the amenities of the area, in accordance with Policies LP16 and LP29 of the Peterborough Local Plan (2019) and Chapter 15 of the National Planning Policy Framework (2024)(2025 as amended).
