Planning conditions
  1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended).
  2. The development hereby permitted shall be carried out in accordance with the following approved plans: - Location Plan, 313 – 001 - Proposed Site Plan, 280 – 051 – 03 - Proposed – Ground Floor, 313 - 100 – 05 - Proposed – First Floor, 313 – 101 -05 - Unit A – Proposed Elevations – NORTH + WEST, 313 – 210 - 05 - Unit A – Proposed Elevations – SOUTH + EAST, 313 – 211 – 04 - Unit A – Proposed Section – 313 – 310 – 01 - Proposed – Roof Plan, 313 – 102 - 01 Reason: For the avoidance of doubt and in the interest of proper planning
  3. The materials to be used in the construction of the external surfaces of the extension hereby permitted shall match those used in the existing building and the approved elevations as listed below: - Unit A – Proposed Elevations – NORTH + WEST, 313 – 210 - 05 - Unit A – Proposed Elevations – SOUTH + EAST, 313 – 211 – 04 Reason: For the Local Planning Authority to ensure a satisfactory external appearance, in accordance with Policy LP16 of the Peterborough Local Plan (2019) and Section 14 of the National Planning Policy Framework (2026).
  4. No development shall take place until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. The Construction Management Plan shall include but not be limited to the following:- a) A scheme of chassis and wheel cleaning for all construction vehicles to include the details of location and specification of the system, together with hard surfacing laid between the apparatus and public highway in either concrete or tarmacadam, to be maintained free of mud, slurry and any other form of debris whilst in use. A contingency plan including if necessary the temporary cessation of all construction operations to be implemented in the event that the approved vehicle cleaning scheme fails to be effective for any reason. b) Haul routes to the site c) Hours of delivery. d) Banksman to ensure that vehicles can access the site upon arrival to ensure that there is no queuing on the public highway. e) Details of site compounds, storage area and contractor and visitor parking. f) Details of any temporary lighting which must not directly light the public highway. The development shall thereafter be carried out in accordance with the approved Construction Traffic Management Plan. Reason: In the interests of highway safety in accordance with Policy LP17 of the Peterborough Local Plan 2019 and Section 15 of the National Planning Policy Framework 2026. This is a pre-commencement condition as the CMP needs to be in place before works start on site.
  5. Prior to the first occupation of the development a full travel plan shall be submitted to and approved in writing by the Local Planning Authority. The travel plan shall be written in accordance with current industry best practice including guidance of the Department of Transport. The development shall thereafter be occupied/operated in accordance with the approved travel plan or a plan as subsequently modified and approved in writing by the Local Planning Authority. Reason: In the interests of promoting sustainable transport and development, in accordance with Policy LP13 of the Peterborough Local Plan (2019).
  6. No part of the development hereby permitted shall be first occupied until a car park management plan has been submitted to and agreed in writing by the Local Planning Authority. The plan shall include how the proposed ANPR system operates, removal of staff 'white card' passes, and appropriate remedial measures if the car park is observed to operate at capacity (85% or more of total capacity). Thereafter the agreed car park management plan shall be implemented in accordance with the approved details. Reason: To manage parking demand to reduce the possibility of the proposed development leading to on-street parking problems locally in the interests of highway safety and in accordance with Policy LP13 of the Peterborough Local Plan (2019) and the National Planning Policy Framework (2026).
  7. Prior to the first occupation or commencement of use, details the additional ANPR camera shall be submitted and agreed in writing with the Local Planning Authority; and retained in perpetuity. Reason: In the interest of highway safety, in accordance with Policy LP13 of the Peterborough Local Plan (2019) and Section 15 of the National Planning Policy Framework 2026.
  8. The development shall be carried out in accordance with the approved plans and at no time shall there be any sub-division of the hereby extended unit. Reason: The site has been assessed with regard to the size of units, as set out on the plans and in the submitted Retail Statement (and updates) and any change in unit size would necessitate a further sequential assessment under the requirements of Policy LP12 of the Peterborough Local Plan (2019) and provisions of the National Planning Policy Framework 2026.
  9. The premises shall be used only for the for the display or retail sale of goods, other than hot food, principally to visiting members of the public (use Class E(a)), and for no other purpose (including any other purpose in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification). Reason: Further assessment would be necessary to ascertain whether any alternative use would be acceptable in terms of the sequential test/retail impact, highway safety or visual impact, in accordance with Policies LP12, LP13, LP16 of the Peterborough Local Plan (2019) and the provisions of the National Planning Policy Framework 2026.
