The site is located in a countryside location, in close proximity to the closest defined settlement of Cold Inn, which is categorised a Small Local Village . The proposal is for a glamping pod. The proposal does not relate to an enterprise for which a countryside location is essential and would introduce a new residential development for holiday accommodation in an area where this development is not permitted, either by virtue of build development which requires a relationship with a settlement with greater service provision or its location in an area where caravan development is restricted. As such, the proposal conflicts in part with the strategic aims of policy SP 1 (Sustainable Development), criterion 1 of policy SP 16 (The Countryside) and the detail of criteria 1 and 5 of policy GN.1 (General Development Policy), criterion A of policy GN.17 (Self-Catering and Serviced Accommodation) criterion A of (Touring Caravan and Tent Sites) and criterion A of policy GN.19 (Static Caravan Sites) of the Local Development Plan (adopted 28 February 2013). There are no site specific material considerations which justify making an exception to the requirements of the Development Plan.
The application fails to include a Green Infrastructure Statement to demonstrate how a stepwise approach has been taking to appraising the site and how green infrastructure has been incorporated into the design of the proposed development. Furthermore, the submitted application does not include any details of biodiversity enhancement or green infrastructure. In the absence of such information, the development fails to demonstrate a positive approach to protecting and enhancing biodiversity. The proposal fails to accord with policies SP 1 (Sustainable Development), GN.1 (General Development Policy), GN.37 (Protection and Enhancement of Biodiversity), the advice set out in Supplementary Planning Guidance: Biodiversity (adopted May 2021), Planning Policy Wales Edition 12 and the Environment Act (Wales) 2016.
