- It is considered that based on the evidence available and on the balance of probability, material operations sufficient to commence the approved development under planning application ref. 18/0915/PA were undertaken before 16th January 2024. The development is therefore lawful for the purposes of Section 191 of the Town and Country Planning Act 1990 and a Certificate of Lawfulness should be granted.
