- Based on the information available, and what was evident on site it is considered on the balance of probability that whilst some development has commenced prior to the expiry date of the planning permission (2 October 2017), the development has not been undertaken in accordance with the approved plans refs. CA01 Revision B and CA02 Revision B, with a basement level and external steps to the basement having been constructed without the benefit of planning permission. Accordingly, a Certificate of Lawfulness cannot be issued and the application is refused.
