The proposed development would result in an increase in nitrogen loading to the Milford Haven Inner waterbody of the Pembrokeshire Marine Special Area of Conservation (SAC), a European site designated under the Conservation of Habitats and Species Regulations 2017 (as amended). Whilst a Nutrient Neutrality Assessment and Mitigation Strategy has been submitted, the Local Planning Authority is not satisfied, that sufficient information has been provided to demonstrate nutrient neutrality or to conclude beyond reasonable scientific doubt that the proposal would not adversely affect the integrity of the Pembrokeshire Marine SAC. Consequently, the proposal fails to comply with the Conservation of Habitats and Species Regulations 2017 (as amended), Planning Policy Wales and Policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
A significant proportion of the application site comprises registered common land (CL/110). Insufficient information has been submitted to demonstrate that the development could be implemented without unacceptable impacts upon the character and function of the common land, or that the necessary consent pursuant to Section 38 of the Commons Act 2006 could be secured. Therefore the proposal fails to represents an appropriate or deliverable form of development in this location, contrary to Policies SP 1 and GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
The application fails to secure the required contribution towards the provision of local needs affordable housing. As such, the proposal fails to accord with Policies SP 1 Sustainable Development, GN.26 (Residential Development) and GN.28 (Local Needs Affordable Housing) of the Local Development Plan (adopted 28 February 2013), and Affordable Housing Supplementary Planning Guidance (adopted 14th September 2015).
