The evidence available demonstrates that, on the balance of probability, that the external staircase installed at the residential property known as Salty Towers to access the first floor maisonette constitutes operational development that has been in situ in excess of four years prior to the date that the application was submitted to the local planning authority; the development is therefore lawful for planning purposes under Section 191 of the Town and Country Planning Act 1990 (as amended).
