Planning conditions
  1. The development shall begin no later than five years from the date of this decision. Reason: To comply with the requirements of Section 91 of the Town & Country Planning Act 1990 (as amended).
  2. The development shall be carried out in accordance with the following approved plans and documents: 01a Location and Block Plan; 02b Site Plan; 03 Floor Plan - Steel Framed Storage Building; 04 Elevations - Steel Framed Storage Building; and 05 Elevations - Steel Framed Storage Building. Reason: In the interests of amenity and to comply with the requirements of policy GN.1 of the Local Development Plan for Pembrokeshire (Adopted 28th February 2013).
  3. Prior to first use of the development hereby approved a scheme for surface water disposal shall be submitted to and approved in writing by the local planning authority. The scheme shall include an assessment of the sites potential for disposing of surface water by means of a sustainable drainage system, with the results of the assessment provided to the local planning authority. The scheme shall be implemented in accordance with the approved details prior to the first beneficial use of the building hereby approved and retained as such for as long as the development exists. Reason: To ensure that a satisfactory means of drainage is provided, and to accord with policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  4. Prior to first use of the development hereby approved a parking scheme shall be submitted to and approved in writing by the Local Planning Authority. The parking shall detail a plan which details the provision of one accessible parking space and cycle provision within the site. The scheme shall be implemented in accordance with the approved details prior to the first beneficial use of the site for the development hereby approved and retained as such for as long as the development exists. Reason: To ensure that a satisfactory means of drainage is provided, and to accord with policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  5. The three native fruit and hedgerow trees, identified in the Green Infrastructure Statement and the details shown on drawing ref. 02b Site Plan, shall be planted in the first planting and seeding seasons following first use of the site or completion of the approved development, whichever is sooner. Any new plants or trees planted in accordance with the approved scheme which, within a period of 5 years after planting are removed, die, become diseased or damaged to such extent that, in the opinion of the Local Planning Authority, the function in relation to this planning approval is no longer delivered, shall be replaced with plants or trees of similar size and specification. Reason: To protect and enhance biodiversity interests and to accord with Policies GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  6. Prior to first use of the building hereby approved, the proposed bird and bat boxes shall be installed in accordance with the Green Infrastructure Statement and the details on drawings 05 Elevations - Steel Framed Storage Building and retained thereafter. Reason: In the interests of biodiversity enhancement and to accord with the requirements of policy GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  7. Any external lighting proposed in connection with the approved development shall be positioned at a low level, downward facing, hooded with a light temperature below 2700k and on a short PIR activated timer and retained as such thereafter. Reason: In the interests of biodiversity and to accord with Policy GN.37 (Protection and Enhancement of Biodiversity) of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  8. Having regard to the details of the application proposals, and the relevant provisions of the Local Development Plan for Pembrokeshire (adopted 28 February 2013) as summarised below Policies SP 1, SP 3, SP 12, SP 13, SP 16, GN.1, GN.2, GN.5, GN.6, GN.22 and GN.37. It is considered that subject to compliance with the conditions attached in this permission, the proposed development would be in accordance with the Development Plan.   9. This permission shall not be construed as granting rights to carry out works on, or over, land not within the ownership, or control, of the applicant.
  10. You must obtain the prior written consent of the owner and occupier of any land upon which it is necessary for you to enter in order to construct, externally finish, decorate or in any other way carry out any works in connection with this development including future repairs/maintenance, or to obtain support from adjoining property. This permission does not authorise you to take such action without first obtaining this consent. Your attention is also drawn to the Access of Neighbouring Land Act 1992 and Party Wall Act 1996.
  11. This Decision Notice grants planning permission. You are advised that it does not constitute approval under the Building Regulations.
  12. Under the Wildlife and Countryside Act 1981 it is an offence to damage, destroy or obstruct access to any structure or place that bats, great crested newts or any other animal listed in Schedule 5 of the Act use for shelter or protection. Under this Act it is also an offence to disturb barn owls whilst building a nest or in the vicinity of a nest containing eggs or young.   13. Pembrokeshire County Council as SuDS Approving Body (SAB) considers that by virtue of the fact that the construction area having drainage implications appears to be in excess of 100 square metres / more than one property; the proposed works will require SAB approval prior to the commencement of any works on site relating to this application. The applicant should be made aware that if there is a breach of the requirement for SAB approval (i.e. when construction work is commenced without SAB approval); the SAB may at any time issue an enforcement notice. The failure to obtain SAB approval may have a detrimental effect upon the future sale of the properties, which could also result in insurance applications and or flood event settlements being compromised.   14. This application has been screened in accordance with Natural Resources Wales’ interim advice for planning applications within the river Special Areas of Conservation (SACs) catchments. It is considered that this development is unlikely to increase phosphate and nitrate inputs as it falls within the following criterion in the interim advice: Criterion 5: Any developments intended to provide services, facilities, commercial sites, or places of employment for a local population already served by residential connections to existing public or private sewers discharging within the SAC catchment (e.g., community buildings, schools etc.)
