Decision & conditions

Refused
Planning conditions
  1. On the basis of the information submitted, it has not been demonstrated that the existing building benefits from an extant lawful residential use such that the proposal can be regarded as a replacement dwelling. The proposal has therefore been assessed as a new residential dwelling within the settlement boundary of Penally. No mechanism has been submitted to secure the required affordable housing contribution in accordance with the Council's adopted policies and guidance. The proposal therefore fails to comply with Policy GN.28 (Local needs Affordable Housing) of the Local Development Plan (adopted 28 February 2013).
  2. Insufficient information has been submitted to demonstrate that the existing access serving the site is capable of safely accommodating demolition, construction and operational traffic associated with the proposed development. The Local Planning Authority is not satisfied that the submitted vehicle tracking information accurately reflects conditions on the ground or demonstrates that vehicles can safely access and egress the site without risk to highway users, pedestrians and users of the Public Right of Way. The proposal therefore fails to demonstrate that safe and suitable access can be achieved and is contrary to criterion 5 of Policy GN.1 (General Development Policy) of the Local Development Plan (adopted 28 February 2013).
