The proposed development is for the variation of condition 2 of planning permission ref. 22/0759/PA to allow for the removal of the roof of the proposed slurry store. The application does not provide sufficient evidence to demonstrate that the development would not have a detrimental impact with on the protected Afon Teifi Site of Special Scientific Interest and Special Area of Conservation with regard to ammonia and as such the proposal fails to comply with the environmental requirements of policy SP 1 (Sustainable Development), criteria of policy GN.1 (General Development Policy) and policy GN.37 (Protection and Enhancement of Biodiversity) of the adopted Local Development Plan for Pembrokeshire (adopted 28 February 2013).
The proposed variation of condition 2 of planning permission ref. 22/0759/PA to allow for the removal of the roof of the proposed slurry store would lead to a harmful increase in terms of odour by the agricultural development. This would be unduly unacceptable for nearby sensitive receptors. As such, the proposal conflicts with the strategic aims of Policy SP 1 (Sustainable Development and the requirements of criterion 2 of policy GN.1 (General Development Policy) of the adopted Local Development Plan for Pembrokeshire (adopted 28 February 2013).
Whilst the application form does not seek to vary the highways condition, the submitted site plan, illustrates 2.4 metres by 33 metres visibility splays. The proposed development fails to demonstrate the provision of adequate visibility splays at the access site commensurate with the speed and nature of the adjoining highway, to the detriment of highway safety. The proposal fails to accord with policy GN.1 (General Development Policy) of the adopted Local Development Plan for Pembrokeshire (adopted 28 February 2013).
The application site lies within the catchment of the Afon Teifi Special Area of Conservation (SAC). A Habitats Regulations Assessment Screening Report has been completed and insufficient information has been provided with the application to conclude that increases in nutrient inputs in the Afon Teifi SAC can be ruled out as a result of this development proposal. As such, the proposal fails to accord with criterion 4 of policy GN.1 (General Development Policy) and GN.37 (Protection and Enhancement of Biodiversity) of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
The application has been submited under Section 73 of the Town and Country Planning Act 1990. It is considered that the variation of the condition would result in a conflict with the original description of the development and therefore to grant planning permission would be unlawful.
