  2.   3. Notwithstanding the details provided on the approved drawings, the window on the south facing elevation of the wall serving Flat 3 on approved drawing number 12 Rev C - Proposed Section and Elevations Sheet 2, shall be first installed with obscure glazing and the lowest opening edge shall be at least 2metres above the internal finished floor level. This arrangement shall remain as such for as long as the approved residential use exists. Reason: To protect the privacy of neighbouring residential occupiers and to accord with Policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  4. Prior to the first occupation of flats 2 and 3 hereby approved as annotated on drawing number 09A - proposed First Floor, full details of the materials to be used in the construction of the external common boundary treatments to afford privacy between flats 2 and 3 and the flat roof area shall be submitted to and approved in writing by the local planning authority. Thereafter the external privacy screens shall be installed prior to the first occupation of flats 2 and 3 and be maintained and retained as first installed for as long as the approved residential use exists. Reason: To protect the privacy of neighbouring residential occupiers and visual amenity of the public realm to accord with Policies GN.1 and GN.2 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  5. The development shall be carried out in accordance with all mitigation and recommendations set out in the Assessment and Recommendation Section of the Roof Nesting Bird and Bat Survey Report, August 2025 by Eryr Gwyn Ecology (Dated as received 19/08/2025). Reason: To ensure that the ecological interests of the site are adequately protected in accordance with GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  6. Prior to the first occupation of the residential units hereby approved all rooflights and sun tunnels detailed on approved drawing 10/Rev A - Proposed roof (Dated as received 20/11/2025) shall be installed. Thereafter these shall be maintained and retained as first installed for as long as the approved residential use exists. Reason: In the interests of the residential amenity of the prospective occupiers to accord with Policies GN.1 and GN.2 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  7. The flat roof area illustrated on approved drawing 10/Rev A - Proposed roof (Dated as received 20/11/2025) shall remain inaccessible as an amenity space and only entered for building maintenance purposes for as long as the approved residential use exists. Reason: In the interests of the residential amenity of the prospective occupiers and their safety to accord with Policies GN.1 and GN.2 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  8. No surface water and/or land drainage shall be allowed to connect directly or indirectly with the public sewerage network from the development hereby approved. Reason: To prevent hydraulic overloading of the public sewerage system, to protect the health and safety of existing residents and ensure no pollution of or detriment to the environment in accordance with Policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  9. The demolition and conversion phases of the development hereby approved shall be implemented in accordance with all recommendations set out within the approved document Construction and Environmental Management Plan, Milford Haven Project, Liongate Construction July 2025 (Dated as received 19/08/2025). Reason: To protect public health, the local amenity and the environment from the adverse impact of unwanted noise emissions in accordance with Policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  10. Prior to the first occupation of the residential units hereby approved the required conversion works shall be carried out in compliance with all the recommendations contained within the Building Regulations ADE2003 Acoustic Design Review; CK Supermarket, Milford Haven by Hunter Acoustics (Ref: 7577/ADR1) August 2025 (Dated as received 19/08/2025) and shall remain and be maintained as first implemented for as long as the residential use hereby approved exists. Reason: In the interests of the residential amenity of the prospective occupiers to accord with Policies GN.1 and GN.2 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  11. Prior to first occupation of any of the residential units hereby approved the cycle parking facilities annotated on approved drawing 09/Rev.A Proposed First Floor (Dated as received 20/11/2025) shall be fully implemented. Thereafter this shall remain and be maintained as first installed for the purposes of cycle parking only for as long as the approved residential use exists. Reason: In the interests of promoting sustainable travel and highway safety in accordance with policy GN.1 of the adopted Local Development Plan for Pembrokeshire (adopted 28 February 2013)
  12. Prior to the first occupation of the residential units hereby approved the bat access tile and low-profile bat box annotated approved drawing 12/Rev.C Proposed Section & Elevations Sheet 2 (Dated as received 13/01/2026) shall be installed in accordance with information contained within the Roof Nesting Bird and Bat Survey Report, August 2025 by Eryr Gwyn Ecology (Dated as received 19/08/2025). Thereafter the bat access tile and low-profile bat box shall be maintained and retained as first installed for as long as the approved residential use exists. If any of these features which, within a period of 5 years after implementation of the approved development, are removed, damaged or become otherwise defective, to such extent that, in the opinion of the Local Planning Authority, the function in relation to this planning approval is no longer delivered, shall be replaced with boxes of similar size and specification. Reason: To ensure that animal and plant species and the ecological interests of the site are adequately protected. Policy: GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013), Section 6 of PPW (Edition 12).
  13. Any external lighting associated with the development hereby approved shall be positioned no higher than 2metres above ground level, be downward facing, hooded and on a short passive infrared (PIR) motion sensor activated timer allowing light to be emitted for no longer than a maximum of one minute. Reason: In the interests of biodiversity and to comply with Policy GN.37 (Protection and Enhancement of Biodiversity) of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  14. Notwithstanding the details provided on the approved plans the planting illustrated on drawing 03/Rev.B Block plan (Dated as received 09/02/2026) shall be planted in the first available planting and seeding seasons following the first occupation of the residential units hereby approved. Any planting which, within a period of 5 years after implementation of the approved development are removed, die, become diseased or damaged to such extent that, in the opinion of the Local Planning Authority, the function in relation to this planning approval is no longer delivered, shall be replaced with plants of similar size and specification. Reason: In the ecological interests of the site in accordance with policies GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  15. Prior to the first occupation of the residential units hereby approved the 1no. sparrow terrace and 1no. swift box shall be installed as annotated on approved drawing number 11/Rev.A Proposed elevations sheet 1 (Dated as received 20/11/2025). Thereafter the sparrow terrace and swift box shall be retained ad maintained as first installed for as long as the approved residential use exists. Reason: In the ecological interests of the site and to enhance biodiversity in accordance with policies GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  16. Having regard to the details of the application proposals, and the relevant provisions of the Local Development Plan for Pembrokeshire (adopted 28 February 2013) as summarised below Policies SP 1, SP 12, SP 13, SP 14, GN.1, GN.2, GN.12, GN.26, GN.28 and GN.37 It is considered that subject to compliance with the conditions attached in this permission, the proposed development would be in accordance with the Development Plan.   17. The applicant is advised that all British bat species are European Protected Species by virtue of their listing under Annex IV of EC Directive 92/43/EEC (The Habitats Directive). This Directive has been transposed into British Law under the Conservation of Habitats and Species Regulations (2017). As the bat survey revealed the presence of a bat, work may require derogation in the form of a licence from NRW, which the developer has to apply for. Before such a licence can be granted, the following tests (specified in Article 16 of the EU Habitats Directive and in regulation 55 (9) of the 2017 Regulations) must be satisfied: (i) there is no satisfactory alternative to the derogation; (ii) the derogation is not detrimental to the maintenance of the populations of the species concerned at a favourable conservation status in their natural range; (iii) the derogation is in the interests of public health and public safety, or for other imperative reasons of overriding public interest, including those of a social or economic nature and beneficial consequences of primary importance for the environment. This planning permission does not provide consent to undertake works that require an EPS licence. It is an offence to deliberately capture, kill or disturb EPS or to recklessly damage or destroy their breeding sites or resting places.
