Planning conditions
  1. The development shall begin no later than five years from the date of this decision. Reason: To comply with the requirements of Section 91 of the Town & Country Planning Act 1990 (as amended).
  2. The development shall be carried out in accordance with the following approved plans and documents: NBLPMH 01 Proposed Ground Floor, received 11/06/2025 NBLPMH 02 Proposed First Floor, received 11/06/2025 NBLPMH 03 Proposed Elevations, received 09/09/2025 NBLPMH 04 Block Plan, received 09/09/2025 NBLPMH 05 Site Location Plan, received 21/08/2025 NBLPMH 06 Section Through, received 13/10/2025 Green Infrastructure Statement, received 09/09/2025 Reason: In the interests of amenity and to comply with the requirements of policy GN.1 of the Local Development Plan for Pembrokeshire (Adopted 28th February 2013).
  3. The garage hereby permitted shall be used solely for the applicant's private, non-commerical vehicle restoration and shall not be used for any trade, business or commerical activity. Reason: To protect the local amenity of nearby residential dwellinghouses, and to accord with Policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  4. Any additional external lighting in connection with the proposed development shall be positioned at a low level, hooded, downward facing and shall be operated on a PIR activated timer. Reason: To maintain and enhance biodiversity, in accordance with policies GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  5. The soft landscaping comprising two fruit trees, the location of which is shown on drawing no. NBLPMH/04 shall be carried out in the first planting season following first use of the building or the substantial completion of the development, whichever is sooner and retained thereafter. Any trees which within a period of 5 years from the date of this decision die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species. Reason: To protect and enhance biodiversity interests and to accord with Policies GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  6. The biodiversity enhancement measures in the form of one bird and one bat box, as detailed in the Green Infrastructure Statement (received 09/09/2024) and illustrated on drawing no. NBLPMH / 03, shall be installed prior to substantial completion of the building hereby permitted or first use of the building whichever is sooner and retained thereafter for as long as the development exists. Reason: To secure biodiversity enhancement, in accordance with policies GN.1 and GN.37 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  7. If evidence of contamination is found in or around the development area, development must nor proceed until a report on potential contamination of the site has been prepared by an appropriately qualified person and submitted to and approved by the local planning authority. This report shall include a phased investigation approach, incorporating risk assessment, to identify the extent of contamination and any measures required to remediate the site, including post-development monitoring. Where remediation works are required, the development shall not be occupied/used until a Validation Report, to show that the works have been satisfactorily carried out, has been submitted and approved in writing by the local planning authority. Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to control waters, property and ecological systems and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors, in accordance with Policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
  8. Having regard to the details of the application proposals, and the relevant provisions of the Local Development Plan for Pembrokeshire (adopted 28 February 2013) as summarised below Policies SP 1, GN.1, GN.2 and GN.37 It is considered that subject to compliance with the conditions attached in this permission, the proposed development would be in accordance with the Development Plan.   9. This permission shall not be construed as granting rights to carry out works on, or over, land not within the ownership, or control, of the applicant.
  10. You must obtain the prior written consent of the owner and occupier of any land upon which it is necessary for you to enter in order to construct, externally finish, decorate or in any other way carry out any works in connection with this development including future repairs/maintenance, or to obtain support from adjoining property. This permission does not authorise you to take such action without first obtaining this consent. Your attention is also drawn to the Access of Neighbouring Land Act 1992 and Party Wall Act 1996.
  11. This Decision Notice grants planning permission. You are advised that it does not constitute approval under the Building Regulations.
  12. The proposed garage is within 30m of a watercourse, therefore, it is important that consideration and appropriate provisions are in position to manage pollution such as dust, silt, surface water run-off and storage of materials and waste during the construction phase. Precautions must be in place to ensure no contamination of local watercourses.   13. As there are hedgehog records in the area it is recommended that the applicant be informed that hedgehogs receive protection under Schedule 6 of the Wildlife and Countryside Act 1981 from capture or killing. Care should therefore be taken during site clearance and construction to ensure that no hedgehogs are killed or injured.
  14. The off-street parking facilities (for all vehicles, including cycles) shown on the plan hereby approved shall be provided before the building is first occupied, and thereafter retained for that purpose. Reason: To ensure the satisfactory provision of parking facilities and in the interest of highway safety and the amenity of the area, and to accord with Policy GN.1 of the Local Development Plan for Pembrokeshire (adopted 28 February 2013).
