Time Limit - Variation (s73) The development to which this permission relates must be begun not later than the 13 January 2029 being three years from the date of approval of the original permission (reference no. 25/0411/FUL) which this approval varies. Reason: To reflect the time limit for commencement imposed on the initial approval and required pursuant to Section 92 of the Town and Country Planning Act 1990 (as amended).
Approved Plans The development hereby approved shall be carried out in complete accordance with the plans and specifications detailed below and shall relate to no other plans: a) Proposed Site Layout and Floorplan - Drawing no. 251004-NAP-ZZ-XX-DR-A-01001 Rev 6, date received 22 July 2026 b) Proposed Elevations 1 - Drawing no. 251004-NAP-ZZ-XX-DR-A-02001 Rev 5, date received 22 July 2026 c) Proposed Elevations 2 - Drawing no. 251004-NAP-ZZ-XX-DR-A-02002 Rev 4, date received 31 July 2026 Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
Materials - Approved Details The development hereby approved shall be carried out in complete accordance with the external finishing materials detailed in the approved plans, or in accordance with details to be submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details. Reason: To ensure the use of appropriate materials in the interests of the visual amenities of the area having regard for Policies DC1, CS4 and CS5 of the Local Plan and section 14 of the NPPF.
Hours of Operation The use shall not operate outside the hours 09:00-19:30 Monday to Friday Reason: In the interests of amenity of residents having regard for Policy DC1 of the Local Plan and section 14 of the NPPF.
Operation of community facility Notwithstanding the provisions of Schedule 2, Part 3 of the the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking or re-enacting that order with or without modification), the proposed community facility shall only operate as described in the approved Design and Access statement and shall not operate for any other use or purpose. Reason: In the interests of the amenities of the area and nearby residents having regard for Policy DC1 of the Local Plan and section 14 of the NPPF.
External Amplification Systems No speakers, tannoy, address system or amplified music system shall be installed or operated to the exterior of the building or in any external areas. Reason: In the interests of amenity of residents having regard for Policy DC1 of the Local Plan and section 14 of the NPPF.
Cooking facilities on site - no deep frying Not withstanding the information provided as part of the application, there shall be no deep frying equipment and no preparation of deep fried foods within the facility. Reason: To ensure a satisfactory form of development in the interests of the amenities of residents having regard for Policies DC1, CS5 of the Local Plan and section 14 of the NPPF.
Bins Bins will be wheeled to the public highway for collection and then returned to the site thereafter. Bins will not be stored in the open or at the collection point apart from on the day of collection. Reason: In the interests of the amenities of residents to ensure a satisfactory form of development having regard for Policies DC1, CS4 and CS5 of the Local Plan and section 14 of the NPPF.
Insulation/Sound Proofing The internal facing walls of the development hereby approved shall be installed with Ursa Acoustic Roll as a soundproofing measure for the lifetime of the development unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure a satisfactory form of development in the interests of the amenities of residents having regard for Policies DC1, CS5 of the Local Plan and section 14 of the NPPF.
Reason for Approval It is considered that the proposal is in accordance with the Policies within the Local Development Framework Core Strategy and Development Policies document in that the scale, design and materials proposed are appropriate to the site location and there will be no demonstrable adverse impact on adjacent residential amenity. The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including LDF Policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out in the National Planning Policy Framework.
Removal if not in use/operation In the event that the building is not in use or operating as the use hereby approved for a period of 4 months, the building shall be totally removed from the site within 3 months from that date and the site returned to its current condition at the time of this decision. Reason: To prevent the impacts of long-term vacancy such as potential for anti-social behaviours, crime and any associated negative impacts on the character and appearance of the area or to neighbouring amenity.
Advertisement Consent Required This permission does not purport or be deemed to authorise the display of advertisements shown on the submitted plans, for which separate consent is required under the provisions of the Town and Country Planning (Control of Advertisements) Regulations 1992 (as amended).
Environmental Construction Management This informative is aimed at ensuring there are no breaches of environmental legislation on the site throughout the construction phase of the development and contractors and developers should adhere to the following advice. For any further information and advice relating to environmental construction management please contact the authorities Environmental Protection Service. • All demolition, construction works and ancillary operations, including deliveries to and dispatch from the site should be restricted to between the hours: o 08.00 to 18.00 Monday to Friday o 09.00 to 13.00 Saturday o Not at all on Sundays and Bank Holidays. • All work should be carried out in such a manner so as to comply with the general recommendations of British Standards BS 5228-1:2009 + A1:2014 and BS 5228-2:2009 + A1:2014, a code of practice for "Noise and Vibration Control on Construction and Open Sites". • Best practicable means should be employed at all times in order to minimise noise, vibration, dust, odour and light emissions. All items of machinery powered by internal combustion engines should be properly silenced and/or fitted with effective and well maintained mufflers in accordance with manufacturers instructions. • There should be no bonfires on the site
