Planning conditions
  1. Impact on the character and appearance In the opinion of the Local Planning Authority, the cumulative impact of the design, height and location of the side and rear dormers are considered to have a notable harmful impact on the character and appearance of the dwelling, wider street scene and the Marton village and The Grove Conservation area. The development is, therefore, considered to be contrary to the guidance set out in Core Strategy Policy DC1 (b) General Development, CS4(k) Sustainable Development and CS5 (c & h) Design, Policy HI2 of the Middlesbrough Publication Local Plan, Council's Urban Design SPD, and conflicts with the guidance contained within paragraphs 135 (b), 203(f), 210 and 215 of the National Planning Policy Framework 2024
  2. Impact on Residential amenity. In the opinion of the Local Planning Authority, the scale and position of the rear dormer and resulting increase in the massing of the roof is considered to have a dominant and overbearing impact on the main dwelling and patio area of 68 The Grove. The development is considered to be contrary to Core Strategy Policy DC1 (c) General Development and the Council’s Urban Design SPD and conflicts with the guidance contained within paragraph 135(f) of the National Planning Policy Framework 2024.
