Proposal is beyond the scope of S73 The proposed change to the approved hours of operation of the original permission (LPA Ref: 24/0291/FUL) is considered to result in a new permission which directly contradicts the description of the parent application, therefore affecting the operative part of the previous approval. As such the proposal is beyond the scope of Section 73 of the Town and Country Planning Act (1990). The development is considered to be in conflict with the requirements of policy DC1 (a) and the LPA is unable to determine the proposal through this process.
