  1. Reason for Refusal 1: Impact on Conservation Area and Heritage Assets In the opinion of the Local Planning Authority, the proposed development will cause harm to the character and appearance of the Linthorpe Conservation Area by virtue of introducing poor and incongruous forms, layouts, design and materials to the site, as well as the removal of protected trees, contrary to Policies CS4(k and l), CS5(c, f, h and i) and DC1(b) of the Core Strategy and to Paragraphs 207, 213, 214 and 215 of the National Planning Policy Framework.
  2. Reason for Refusal 2: Design/Layout/Arrangement impacts on Residential Amenity In the opinion of the Local Planning Authority, the proposals would provide poor levels of residential amenity for the existing residential occupiers of No. 17 Clepstone Avenue by virtue of the layout of the proposed houses, which is deemed to be contrary to the requirements of Local Plan Policies DC1(c), CS4(l), CS5(c and f) and H30(b) as well as Paragraph 135 of the National Planning Policy Framework.
  3. Reason for Refusal 3: Nutrient Neutrality Not Achieved The proposal would result in an increase in population and a consequential increase in wastewater and nutrients (specifically nitrogen) entering into the drainage system which would, in turn, add to existing nutrient burdens within the River Tees. Unmitigated, this proposal would have an adverse impact on the Teesmouth and Cleveland Coast Special Protection Area, which would be contrary to Local Plan Policies CS4 (j) and DC1 (a) and the NPPF and would fail to meet the legal requirements of the Conservation of Species and Habitat Regulations 2017.
