  1. Approved Plans The development hereby approved shall be carried out in complete accordance with the plans and specifications detailed below and shall relate to no other plans: a. Location plan, received 23rd December 2025 b. Proposed site plan Dwg no. PTK - A1 - 00 - D - A - 1803 REV P03, received 19th December 2025 c. GA Floor plan Dwg no. PTK - A1 - 00 - D - A - 1001 REV P07, received 19th December 2025 d. Roof plan Dwg no. PTK - A1 - 01 - D - A - 1002 REV P03, received 23rd December 2025 e. GA Elevations Dwg no. PTK - A1 - 00 - D - A- 2001, received 23rd December 2025 Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
  2. Time Limit - Variation (s73) The development to which this permission relates must be begun not later than the 31st July 2025 being three years from the date of approval of the original permission (reference no. 25/0215/FUL) which this approval varies. Reason: To reflect the time limit for commencement imposed on the initial approval and required pursuant to Section 92 of the Town and Country Planning Act 1990 (as amended).
  3. Bin Store and Plant Area The development hereby approved shall not be occupied/brought into use until a refuse store and plant area has been provided in accordance with drawing(s) to be submitted to and approved in writing by the Local Planning Authority. Such drawings to show the position, capacity, design, materials and finishes thereof. Thereafter the refuse store and plant area shall be retained for the lifetime of the development. Reason: In the interests of the amenities of residents to ensure a satisfactory form of development having regard for Policies DC1, CS4 and CS5 of the Local Plan and section 12 of the NPPF
  4. Boundary Treatments A plan showing positions, designs, materials and types of any boundary treatments to be erected shall be submitted to and approved in writing by the local planning authority. Reason: In the interests of the amenities, character and appearance of the area having regard for Policies DC1 and CS5 of the Local Plan.
  5. Hours of Opening/Use The premises shall not be open for use outside the hours 9am-8pm Monday to Saturday and 10am -4pm Sunday and Bank Holidays. Reason: In the interests of amenity of residents having regard for Policy DC1 of the Local Plan and section 12 of the NPPF.
  6. Biodiversity Gain Plan The development hereby approved shall not commence until a Biodiversity Gain Plan has been submitted to and approved in writing by the Local Planning Authority. Reason: As required under the statutory framework introduced by Schedule 7A of the Town and Country Planning Act 1990 and having regard for Policy CS4.
  7. Biodiversity Net Gain Maintenance Plan The development hereby permitted shall be carried out in accordance with the approved Biodiversity Gain Plan to ensure that there is a minimum 10% net gain in biodiversity within a 30-year period as a result of the development and the Biodiversity Gain Plan shall be implemented in full. No development shall commence until a Biodiversity Monitoring Plan to ensure that there is a minimum 10% net gain in biodiversity within a 30-year period as a result of the development has been submitted to and agreed in writing by the Local Planning Authority. The Biodiversity Management Plan shall include 30-year objectives, management responsibilities, maintenance schedules and a methodology to ensure the submission of monitoring reports. Monitoring reports will be submitted to the Local Planning Authority during years 2, 5, 7, 10, 20 and 30 from commencement of development unless otherwise stated in the Biodiversity Management Plan, demonstrating how the BNG is progressing towards achieving its objectives, evidence of arrangements and any rectifying measures needed to be undertaken to address a shortfall in predicted levels of gain. Reason: In the interests of ensuring measurable net gains to biodiversity and in accordance with paragraphs 180 and 186 of the National Planning Policy Framework and having regard for Policy CS4.
  8. REASON FOR APPROVAL This application is satisfactory in that the design of the proposed variations accords with the principles of the National Planning Policy Framework (NPPF) and, where appropriate, the Council has worked with the applicant in a positive and proactive way in line with the NPPF. In addition the variations accord with the local policy requirements (Policies CS4, CS5 & DC1 of the Council's Local Development Framework and Emerging Plan Policies CR2 and CR3). In particular the variations are designed so that their appearance is complementary to the site and surroundings and so that they will not have a detrimental impact on the amenity of any adjoining or nearby resident. The variations will not prejudice the character and appearance of the area and will not significantly affect any landscaping nor prevent adequate and safe access to the site. The application is therefore considered to be an acceptable form of development, fully in accordance with the relevant policy guidance and there are no material considerations which would indicate that the development should be refused.
