Planning conditions
  1. Sequential assessment not provided/Impacts on health The hot food takeaway, a main town centre use outside of a defined centre requires a sequential assessment. No sequential assessment has been submitted with the application. In addition the proposal for the use of hot food takeaway is within 200m walking distance of North Ormesby Primary School and St Alphonsus Primary School; and is also within 300-350m of Henry Street Play Area, and Esk Street Play Area and MUGA; and where, as evidence suggests, a concentration of such uses is having an adverse impact on local health contrary to Emerging Policy EC17 and Para 97 of the NPPF.
  2. Undue impact on character and amenity In the opinion of the Local Planning Authority, the proposed change of use and shop frontage would be detrimental to the street scene character of the area and the amenity of nearby residential occupiers in view of the nature of the use and associated impacts contrary to Policies CS5 and DC1 and Emerging Plan Policies CR2 and CR3 and Design Guidance.
