Planning conditions
  1. Time Limit The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason: In order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended).
  2. Approved Plans The development hereby approved shall be carried out in complete accordance with the plans and specifications detailed below and shall relate to no other plans: a) Location Plan and Block Plan - Drawing no. 10, date received 28 May 2025 b) Existing Ground Floorplan- Drawing no. 01, date received 28 May 2025 c) Existing First Floorplan - Drawing no. 02, date received 28 May 2025 d) Existing Second Floorplan - Drawing no. 03, date received 28 May 2025 e) Existing Third Floorplan - Drawing no. 04, date received 28 May 2025 f) Proposed First Floorplan - Drawing no. 08 Rev E, date received 28 Nov 2025 g) Proposed Second Floorplan - Drawing no. 09 Rev E, date received 28 Nov 2025 h) Proposed Third Floorplan - Drawing no. 10 Rev E, date received 28 Nov 2025 i) Noise Management Plan - Received 28 Nov 2025 Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
  3. Use Class C1 The use hereby approved shall not be used for any purpose other than for purposes within Use Class C1 of the Schedule to the Town and Country Planning (Use Classes) Order 1987(or any order revoking or re-enacting that order with or without modification). The use hereby approved shall not be occupied as a person’s sole, or main place of residence. The owner, landlord or authority in control of the development shall keep an up to date register of the name of each person in occupation of the development together with details of their main home addresses and shall make the register available for inspection by the Local Planning Authority on demand at all reasonable times. Reason: The development is not suitable as a permanent place of residence and to ensure a satisfactory form of development having regard for Policies DC1, CS4, CS5 and H11 of the Local Plan and section 12 of the NPPF.
  4. Noise Management The use hereby approved shall be carried out in accordance with the approved Noise Management Plan for the lifetime of the development unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure a satisfactory form of development in the interests of the amenities of residents having regard for Policies DC1, CS5 of the Local Plan and section 12 of the NPPF.
  5. Internal Arrangement - Flats/Apartments (including Students) The internal arrangement of the development hereby approved, including the position of bedrooms and living areas and the size of the rooms, shall be undertaken in accordance with the approved plans and thereafter shall not be altered in any way without the written approval of the Local Planning Authority. Reason: In the interests of the amenities of the residents and to ensure a satisfactory form of development having regard for Policies DC1, and CS5 of the Middlesbrough Local Plan and section 12 of the NPPF.
  6. Reason for Approval It is considered that the proposal is in accordance with the Policies within the Local Development Framework Core Strategy and Development Policies document in that the scale, design and materials proposed are appropriate to the site location and there will be no demonstrable adverse impact on adjacent residential amenity. The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including LDF Policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out in the National Planning Policy Framework.
