Planning conditions
  1. Reason for Refusal 1: Lack of Sequential Assessment In the opinion of the Local Planning Authority, the principle of the development is considered to be unacceptable and the sequential approach has not been followed which is deemed to be contrary to Paragraph 91 of the National Planning Policy Framework, Policy CS13 and EC17.
  2. Reason for Refusal 2: Adverse Impacts on Neighbouring Residents In the opinion of the Local Planning Authority, the pizza takeaway use is considered to have significant adverse impacts on the residential amenity. The application does not include all the relevant up-to-date supporting assessments (namely an up-to-date noise assessment, odour assessment) to allow officers to fully consider the potential impacts of the development on the nearby properties. This is deemed to be contrary to the requirement of Policy DC1(a and c) of the Local Plan.
  3. Reason for Refusal 3: Adverse Impacts on Healthy Community In the opinion of the Local Planning Authority, the pizza takeaway use being directly adjacent to Westbourne Park, a place where young people congregate, would have an adverse impact on local health and would be deemed to be contrary to Local Policy CS4(f), Paragraphs 97 and 135(f) of the NPPF and the PLP Policy EC17.
  4. Reason for Refusal 4: Undermines Safe Environment In the opinion of the Local Planning Authority, the hot food takeaway use presents opportunities for attracting anti-social behaviour which is considered to be in conflict with Local Policy CS5(e) as well as Paragraph 96 and 135 of the NPPF.
