Planning conditions
  1. Time Limit - Advertisements The permission hereby granted for display of the proposed advertisement(s) shall expire five years from the date of this notice. Reason: As is required by part 3 (para 16(2)c) of the Town & Country Planning (Control of Advertisements) Regulations 2007.
  2. Approved Plans The development hereby approved shall be carried out in complete accordance with the plans and specifications detailed below and shall relate to no other plans: a. Location plan Dwg no. 24214 - PA – 01, received 22nd January 2025 b. Proposed site plan Dwg no. 24214 - PA – 03, received 22nd January 2025 c. Existing & proposed elevations Dwg no. 24214 - PA – 04 received 22nd January 2025 Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
  3. Statutory Requirements The advertisements hereby approved must adhere to the statutory requirements detailed below: a) Any advertisement displayed and any site used for the display of advertisements shall be retained in a clean and tidy condition which does not impair visual amenity, cause danger, nuisance or hazard to the public to the reasonable satisfaction of the Local Planning Authority; b) Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a safe condition that does not endanger the public; c) Where an advertisement is required under these Regulations to be removed, the site shall be left in a safe condition that does not cause danger, nuisance or hazard to the public or impair visual amenity to the reasonable satisfaction of the Local Planning Authority; d) No advertisement shall be displayed without the permission of the owner of the site or any other person with an interest in the site entitled to grant permission; and, e) No advertisement shall be sited or displayed so as to obscure or hinder the ready interpretation of any road traffic sign, railway signal or aid to navigation by water or air, or so as otherwise to render hazardous the use of any highway, railway, waterway or aerodrome (civil or military). Nor shall any advertisement hinder the operation of any device used for the purpose of security or surveillance or for measuring the speed of any vehicle. Reason: To comply with Regulation 14(1) and Schedule 2 of the Town and Country Planning (Control of Advertisement)(England) Regulations 2007 and section 12 of the NPPF.
  4. No moving images There shall be no moving images, animation, video or full motion images displayed unless otherwise permitted by this consent. Reason: In the interests of amenity and highway safety having regard for policies DC1 and CS5.
  5. Illuminatation - in the hours of darkness In the hours of darkness, the advertisement display luminance shall be no greater than 300cd/m2 in accordance with the recommended maximum night time luminance value set out for Environmental Zone 4 in Table 10.4 within the Institution of Lighting Professionals - Professional Lighting Guide (PLG 05) 'Brightness of Illuminated Advertisements including Digital Displays' (or its equivalent in a replacement guide) in cd/m2. Reason: In the interests of amenity and highway safety having regard for policies DC1 and CS5. Reason: To protect the visual and residential amenities of the area having regard for policies DC1, CS4 and CS5 of the Local Plan and section 12 of the NPPF.
  6. Illumination - day light hours In daylight hours, the advertisement display luminance shall be controlled in order to reflect ambient light conditions (to ensure it is neither too bright or too dull), and shall at all times be no greater than the recommended maximum daytime luminance values set out in Table 10.5 within the Institution of Lighting Professionals - Professional Lighting Guide (PLG 05) 'Brightness of Illuminated Advertisements including Digital Displays' (or its equivalent in a replacement guide) in cd/m2. Reason: In the interests of amenity and highway safety having regard for policies DC1 and CS5.
  7. Display time The minimum display time for each advertisement shall be 10 seconds and the advertisement shall not include any features which would result in interactive messages / advertisements being displayed. Reason: In the interests of amenity and highway safety having regard for policies DC1 and CS5.
  8. Advert succession The interval between successive advertisements shall be no greater than 1 second and the complete display shall change without effect. The display to include a mechanism to default to a blank or black screen in the event of malfunction, or if the advertisement is not in use. Reason: In the interests of amenity, public safety and in order to retain effective planning control.
  9. REASON FOR APPROVAL The application is satisfactory in that the design and appearance of the proposed signage accords with the principles of the National Planning Policy Framework (NPPF). In addition the signage accords with the local policy requirements (Policy CS5 & DC1 of the Council's Local Development Framework). In particular the signage is designed so that its appearance is complementary to the area and will not have a detrimental impact on the appearance of the streetscene or any nearby properties. The proposed signage will not prejudice highway safety either by obscuring visibility or be of a conspicuous or prominent appearance. The application is therefore considered to be acceptable, fully in accordance with the relevant policy guidance and there are no material considerations which indicate that the application should be refused
