Planning conditions
  1. Cabin building In the opinion of the Local Planning Authority, the cabin building by virtue of its, design and location is considered to be in conflict with Local Development Plan Policies DC1 and CS5, as it does not constitute high quality design/accommodation and would appear at odds with its surroundings and would not contribute positively to the character and appearance of the area.
  2. Unsustainable location In the opinion of the Local Planning Authority the combination of lack of suitable infrastructure serving the proposed cabin and remote nature will result in development which is wholly reliant on the private car and as such considered to be unsustainable contrary to Policies CS4, CS18, and CS19
  3. Nutrient Neutrality not achieved The proposal would result in an increase in population and a consequential increase in wastewater and nutrients (specifically nitrogen) entering into the drainage system which would, in turn, add to existing nutrient burdens within the River Tees. Unmitigated, this proposal would have an adverse impact on the Teesmouth and Cleveland Coast Special Protection Area, which would be contrary to Local Plan Policies CS4 and DC1 and the NPPF and would fail to meet the legal requirements of the Conservation of Species and Habitat Regulations 2017.
  4. The cabin shall be removed from site within 28 days from the date of this notice and land reinstated. Failure do so will result in enforcement action being taken.
