Planning conditions
  1. Time Limit The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason: In order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended).
  2. Approved Plans The development hereby approved shall be carried out in complete accordance with the plans and specifications detailed below and shall relate to no other plans: a) Location, Block Plan and Existing Roof Plan - Drawing no. 03, received 20 June 2024 b) Proposed Floorplans - Drawing no. 05, received 20 June 2024 c) Proposed Roof Plan - Drawing no. 06, received 20 June 2024 d) Proposed Elevations - Drawing no. 07, received 20 June 2024 Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
  3. Materials - Matching The materials to be used in the construction of the external surfaces (including walls, roof & windows) of the development hereby permitted shall match those used in the existing building, or shall be in accordance with details which have first been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details. Reason: To ensure the use of appropriate materials in the interests of the visual amenities of the area having regard for policies DC1, CS4 and CS5 of the Local Plan and section 12 of the NPPF.
  4. Ventilation/Fume Extraction System Prior to the commencement of development details of a ventilation and fume extraction system suitable for uses within class A3 and A5, including a full technical specification by a suitably qualified person, specifying the position of ventilation fume or flue outlet points and the type of filtration or other fume treatment to be installed and used at the premises in pursuance of this permission, shall be submitted to and approved in writing by the local planning authority. The approved scheme must be installed before the use hereby permitted commences and thereafter shall be retained on site in full accordance with the approved details in an operational state for the lifetime of the building. The ventilation and extraction system shall be operated and maintained in accordance with the manufacturers recommendations including the frequency of replacement filters. Reason: To ensure a satisfactory form of development in the interests of the amenities of residents having regard for policies DC1, CS5 of the Local Plan and section 12 of the NPPF.
  5. Hours of Opening/Use (cafe/restaurant and retail) The premises in use as the cafe/restaurant and retail units shall not be open for customers/use shall not operate outside the hours: Monday-Friday: 06:30-23:00, Saturday: 06:30-00:00, Sunday (including Bank Holidays): 10:00-18:00 Reason: In the interests of amenity of residents having regard for policy DC1 of the Local Plan and section 12 of the NPPF.
  6. Hours of Opening/Use (hot food takeaway) The premises in use as the hot food takeaway shall not be open for customers/use shall not operate outside the hours: Monday-Friday: 11:30-23:00, Saturday: 11:30-00:00, Sunday (including Bank Holidays): 15:00-22:00 Reason: In the interests of amenity of residents having regard for policy DC1 of the Local Plan and section 12 of the NPPF.
  7. Reason for Approval It is considered that the proposal is in accordance with the Policies within the Local Development Framework Core Strategy and Development Policies document in that the scale, design and materials proposed are appropriate to the site location and there will be no demonstrable adverse impact on adjacent residential amenity. The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material considerations, including LDF Policies and any representations that may have been received and subsequently determining to grant planning permission in accordance with the presumption in favour of sustainable development, as set out in the National Planning Policy Framework.
