Time Limit The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason: In order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended).
Approved Plans The development hereby approved shall be carried out in complete accordance with the plans and specifications detailed below and shall relate to no other plans: a. Site location plan 72701079-SLP dated 24th May 2024 b. Existing elevation plans 72701079-EE dated 24th May 2024 c. Existing layout plan 72701079-LP-REV-B dated 25th October 2024 d. Proposed elevation plan 72701079-A dated 25th October 2024 e. Proposed layout plan 72701079-LP-REV-C dated 25th October 2024 Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
Hedge Planting Prior to the proposed access gates being brought into use, the additional hedging along the front boundary of the site shall be planted in accordance with the proposed site layout plan drawing 72701079-LP-REV-C dated 25th October 2024. Thereafter the hedgerow shall be retained and maintained for the lifetime of the development, unless agreed in writing by the Local Planning Authority. Reason : To ensure a satisfactory form of development in the interest of visual amenity and the character of the area having regard for policies CS4, CS5 and DC1 of the Local Plan and sections 12 and 15 of the NPPF.
Reason for approval This application is satisfactory in that the proposed security fencing and automatic vehicle access gates within the grounds of the East Parkside Village accord with the principles of the principles of the National Planning Policy Framework (NPPF) and the local policy requirements (Policy DC1, CS4, CS5) Where appropriate, the Council has worked with the applicant in a positive and proactive way in line with the guidance within the NPPF (2023). In particular, the proposed security fencing and automatic vehicle access gates will not prejudice the character and appearance of the street scene , the Linthorpe and Albert Park Conservation area or the setting of the nearby Grade II listed Albert Park. The proposal will not significantly affect any landscaping or prevent adequate and safe access to the site or highway safety. The application is therefore considered to be an acceptable form of development, fully in accordance with the relevant policy guidance and there are no material considerations which would indicate that the development should be refused.
Fence/Gate Design Cleveland Police have advised that the weldmesh fencing is of a gauge size that will restrict climbing and that the fence top is unfinished to act as an additional climbing deterrent.
