Planning conditions
  1. Time Limit The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason: The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990.
  2. Approved Plans The development hereby approved shall be carried out in accordance with the following plans and specifications. (a) Location Plan (b) Proposed Site Plan – Page 04 (Revision 4, 19/09/24) (c) Proposed Floor Plans and Elevations – Page 02 (Revision 3, 19/08/24) (d) Proposed Boundary Plan and Elevations – Page 05 (Revision 3, 19/09/24) Reason: To ensure a satisfactory form of development and for the avoidance of doubt.
  3. Construction of Boundary Treatment Before Operation The approved place of worship shall not come into operation until the new wall and rail boundary treatment has been fully constructed around the site boundary. Reason: To ensure a satisfactory form of development and in the interests of highway safety having regard for policies CS5 and DC1 of the Local Plan and sections 9 and 12 of the NPPF.
  4. Noise Mitigation Measures The development hereby permitted shall not come into use until the noise mitigation measures as outlined in Table 1 of the Noise Impact Assessment 11936.1 Rev A have been carried out in accordance with the approved plans. The mitigation measures shall be retained in perpetuity. Reason: To ensure a satisfactory form of development in the interests of the amenities of residents having regard for policies DC1, CS5 of the Local Plan and section 12 of the NPPF.
  5. Soft Landscaping Works Prior to the first use of the place of worship hereby approved, a detailed scheme for tree planting and associated soft landscaping works (based on the indicative landscaping proposals on the Approved Site Plan drawing) shall be submitted to and approved in writing by the Local Planning Authority. The detailed scheme shall include details of the proposed trees and plants (prioritising native species) to be planted, including their species, size and location, as well as an implementation and maintenance programme. The tree planting and associated landscaping works shall take place during the first available planting season (October-March) following the completion of building works on the site. The Local Planning Authority shall be notified within two weeks of the landscape planting works. Reason: To ensure a satisfactory form of development in the interest of visual amenity and the character of the area having regard for policies CS4, CS5 and DC1 of the Local Plan and sections 12 and 15 of the NPPF.
  6. Replacement Tree Planting If within a period of five years from the date of the planting of any tree that tree, or any tree planted in replacement for it, is removed, uprooted or destroyed or dies, or becomes, in the opinion of the local planning authority, seriously damaged or defective, another tree of the same species and size as that originally planted shall be planted at the same place, unless the local planning authority gives its written consent to any variation. Reason: To ensure a satisfactory form of development in the interest of visual amenity and the character of the area having regard for policies CS4, CS5 and DC1 of the Local Plan and sections 12 and 15 of the NPPF.
  7. Cycle Store Details The development hereby approved shall not be occupied/brought into use until covered and secure cycle parking facilities, for 8 cycles, have been provided in accordance with drawing(s) to be submitted to and approved in writing by the Local Planning Authority. Such drawings to show the position, design, materials and finishes thereof. Thereafter the cycle parking facilities shall be retained in perpetuity for the sole purpose of parking cycles. Reason: To promote use of cycles reducing traffic congestion and in the interests of the amenities of residents to ensure a satisfactory form of development having regard for policies DC1, CS4 and CS5 of the Local Plan and sections 9 and 12 of the NPPF.
  8. REASON FOR APPROVAL This application is satisfactory in that the change of use from mixed E use class to a place of worship accords with the principles of the National Planning Policy Framework (NPPF) and the local policy requirements. In particular, the place of worship will not prejudice the character and function of the local area but will complement its existing commercial and community uses and it will not be detrimental to any adjoining or surrounding properties. The traffic generated, car parking and noise associated with the use will not be of a level likely to result in an unacceptable impact on nearby premises. The application is therefore considered to be an acceptable form of development, fully in accordance with the relevant policy guidance and there are no material considerations, which would indicate that the development should be refused.
