- The submitted Unilateral Undertaking (UU), intended to secure the development as parking permit free, has not been legally executed, as it has not been signed and dated in the presence of a solicitor. In the absence of a valid executed UU, the Local Planning Authority cannot be satisfied that the requirements of Condition C2 have been met. Accordingly, the application to discharge Condition C2 is refused and the details are contrary to policies 48 and 55 of the Local Plan 2025.
- The submitted Construction Management Plan does not provide sufficient detail to demonstrate that the construction phase can be managed without undue impact on the public highway. Accordingly, the details submitted are considered inadequate and contrary to policy 48 of the Local Plan 2025. The condition cannot be discharged at this time.
- For the avoidance of doubt the Drawing(s) No(s) and Document(s) to which this decision refers are as follows:- APPROVED: Proposed refuse storage (ref. FEE/P25/100); Proposed Site Layout & Ground Floor Plan (ref. HR-REF/P25/03); and Existing Ground Floor Plan (ref. HRT/P25/02). REFUSED: Deed of Unilateral Undertaking; and Construction Management Plan dated 17.07.26.
