The proposed alterations to amend the description of development and to add a condition enabling the development to be phased is not considered to be a non-material amendment under the provisions of Section 96A of the Town and Country Planning Act 1990 (as amended). The proposed changes are material in relation to the original approval and result in a development that may appear noticeably different to what interested parties may have envisaged or could result in an impact on the amenity of occupiers of adjoining properties.
