  1. This proposal CONSTITUTES DEVELOPMENT within the meaning of Section 55 of the Town and Country Planning Act 1990, but by virtue of Article 3 and Schedule 2 of the Town and Country (General Permitted Development) (England) Order 2015 and any subsequent legislative amendments is of a class which is described as PERMITTED DEVELOPMENT and therefore planning permission IS NOT REQUIRED subject to the following conditions: (a) the materials used in any exterior work (other than materials used in the construction of a conservatory) shall be of a similar appearance to those used in the construction of the exterior of the existing dwellinghouse; (b) any upper-floor window located in a wall or roof slope forming a side elevation of the dwellinghouse shall be: (i) obscure-glazed, and (ii) non-opening unless the parts of the window which can be opened are more than 1.7 metres above the floor of the room in which the window is installed; and (c) where the enlarged part of the dwellinghouse has more than one storey, the roof pitch of the enlarged part shall, so far as practicable, be the same as the roof pitch of the original dwellinghouse.
  2. For the avoidance of doubt the Drawing(s) No(s) and Document(s) to which this decision refers are as follows:- Location Plan; Existing Ground Floor Plan (No. 265_010); Existing Floorplans and Elevations (No. 001 Rev 01); Proposed Ground Floor Plan; Proposed First Floor Plan (No. 265_031); Proposed Side Elevation (No. 265_044); Details Plans re: internal steel beams and external brickwork replacement (No. Sheets 003, 004, 005).
  3. The submitted plans show a dormer window approved under separate Certificate of Lawfulness ref. PA25/1331. These works do not form part of the current application and are not covered by this certificate hereby granted. The rooflight shown at first floor level on the approved drawings does not form part of the development certified as lawful under this application. The applicant is advised that planning permission is required for the installation of this rooflight and a separate application should be submitted to the Local Planning Authority. For clarity, no enlargement to the building is approved as part of this decision.
