Decision & conditions

Refused Permission

Appeal status: Appeal lodged

decision
Planning conditions
  1. The proposed rear dormer, by reason of scale and design, would represent an overly dominant and incongruous form of overdevelopment that would erode the original appearance of the host property. The scheme would cause less than substantial harm to the Madrid Road Conservation Area of which it forms part, and there are considered to be no public benefits to outweigh this harm. As such, the proposal would be contrary to the NPPF (2026), the House Extensions and External Alterations (2015) SPD and the Local Plan (2025) policies 28 & 29, as supported by the Madrid Road Conservation Area Statement and study.
  2. For the avoidance of doubt the Drawing(s) No(s) and Document(s) to which this decision refers are as follows: Location Plan, 2602-PL-100 Rev A, 2602-PL-101, 2602-PL-102, 2602-PL-103, 2602-PL-104, 2602-PL-105, 2602-PL-106, 2602-PL-201 Rev A, 2602-PL-202 Rev A, 2602-PL-203 Rev A, 2602-PL-204, 2602-PL-205 Rev A, 2602-PL-206 Rev A & 2602-PL-207 Rev A received on 26 Jun 2026.
  3. In accordance with paragraphs 38-42 of the National Planning Policy Framework, Richmond upon Thames Borough Council takes a positive and proactive approach to the delivery of sustainable development, by: * Providing a formal pre-application service * Providing written policies and guidance, all of which is available to view on the Council's website * Where appropriate, negotiating amendments to secure a positive decision * Determining applications in a timely manner. In this instance: * The applicants did not seek formal pre-application advice, and the scheme was found to be contrary to policy and guidance, and subsequently refused. The Council is ready to enter into discussions, through the Council's formal pre-application service, to advise the applicants of relevant policy and guidance; and where possible assist in the preparation of a new planning permission. More information on the pre-application service and relevant fees can be found online at www.richmond.gov.uk/pre-application_for_developers.
  4. The proposed single-storey rear extension, by reason of its combined height, depth and siting is likely to result in an overbearing sense of enclosure and visually intrusive form of development that will adversely impact on the residential amenity of nearby occupants, in particular, No.94 Madrid Road. The proposed development would thereby be contrary to, in particular, policy LP46 of the Local Plan (2025) and the council's 'House Extensions and External Alterations' (2015) Supplementary Planning Document.
