Decision & conditions

Refused Permission
Decision
Planning conditions
  1. The proposed development, by reason of its siting, size, scale, bulk and design would result in an unsympathetic and incongruous form of development that fails to preserve or enhance the character and appearance of the surrounding conservation area. The proposed development would cause less than substantial harm to the Hanworth Road Hampton Conservation Area, with no public benefits to outweigh this harm. As such, the proposal is contrary to Local Plan policies 28 and 29, Supplementary Planning Document 'House Extensions and External Alterations' (2015), the Hampton Hill Conservation Area Statement and Hampton Hill Conservation Area Study, Section 72 (1) of the Planning (Listed Buildings and Conservation Areas) Act 1990, Policy HC1 (C) of the London Plan (2021) and paragraphs 212-215 of the NPPF (2024).
  2. The development, by reason of the absence of an Arboricultural Impact Assessment, Tree Protection Plan (TPP) and Arboricultural Method Statement has failed to demonstrate that the proposal would not detrimentally impact on the health and longevity of nearby trees to the detriment of the visual amenity of the locality and the character and appearance of the conservation area. The proposal is contrary to the NPPF and, in particular, policies 28 and 42 of the Local Plan and the Trees and Development SPD (2026).
  3. For the avoidance of doubt the Drawing(s) No(s) and Document(s) to which this decision refers are as follows:- Received 17 June 2026: Application Form Design and Access Statement Flood Risk Assessment (EA) 00 01 02 03 04 05 06 08 09 10 11 12 - A 12A - Fire Safety Diagram 12A - Rev B 13 - Rev A 14 - Rev A 15 - Rev A 16 - Rev B 17 - Rev A 18 - Rev C 19 - Rev A 20 21 - Rev C Fire Strategy - received 27 July 2026
  4. In accordance with paragraphs 38-42 of the National Planning Policy Framework, Richmond upon Thames Borough Council takes a positive and proactive approach to the delivery of sustainable development, by: * Providing a formal pre-application service * Providing written policies and guidance, all of which is available to view on the Council's website * Where appropriate, negotiating amendments to secure a positive decision * Determining applications in a timely manner. In this instance: * The applicants did not seek formal pre-application advice, and the scheme was found to be contrary to policy and guidance, and subsequently refused. The Council is ready to enter into discussions, through the Council's formal pre-application service, to advise the applicants of relevant policy and guidance; and where possible assist in the preparation of a new planning permission. More information on the pre-application service and relevant fees can be found online at www.richmond.gov.uk/pre-application_for_developers.
