Under schedule 2, Part 16 of the General Permitted Development Order 2015 (as amended), the Local Planning Authority has determined that Prior Approval is required and hereby REFUSED as to the siting and appearance of the proposed development for the following reasons: The proposal, by reason of its siting, design, bulk, scale, form and appearance, would be an unduly dominant, incongruous and visually intrusive form of development that would adversely affect the character of the Bushy Park Metropolitan Open Land, the character and appearance of Hampton Hill Conservation Area, the setting of the Grade II listed Brick Boundary Walls, the Grade I Bushy Park Registered Park and Garden, the Bushy Park Conservation Area, the locally listed buildings sited along the High Street and harm the locality as a whole. The proposal would therefore be contrary to the Planning (Listed Buildings and Conservation Areas) Act 1990, NPPF (2024), London Plan (2021), Local Plan (2025), and in particular its Policies 27, 28, 29, 30 and 35, the SPD on Telecommunications Equipment and the High Street (Hampton Hill) Conservation Area 38 Conservation Area Statement.
Under schedule 2, Part 16 of the General Permitted Development Order 2015 (as amended), the Local Planning Authority has determined that Prior Approval is required and hereby REFUSED as to the siting and appearance of the proposed development for the following reasons: The proposal, by reason of its siting, scale, proximity to trees and in the absence of sufficient arboricultural and Line of Sight information, has failed to demonstrate that there will be no detrimental impact on the long-term preservation of adjacent and within the locality protected trees to remain or biodiversity and thus the character and appearance of the conservation areas, metropolitan open land and locality as a whole. The scheme is thereby contrary to the NPPF (2024), London Plan (2021), and, in particular Policies 28, 29, 35, 39 and 42 of the Local Plan (2025).
Under schedule 2, Part 16 of the General Permitted Development Order 2015 (as amended), the Local Planning Authority has determined that Prior Approval is required and hereby REFUSED as to the siting and appearance of the proposed development for the following reasons: The proposal, by the displacement of the bins that are currently present and used on site, fails to demonstrate that suitable and sufficient arrangements for the storage and disposal of recycling, textiles and electricals can be provided as a result of the proposed development, not allowing to safeguard the appearance of the Hampton Hill Conservation Area and the amenities of the area and resulting in the likely disruption to the free flow of vehicles and pedestrians. The proposal would therefore fail to comply with Policies 7, 28, 29 and 47 of the Local Plan (2025) and the SPD (2022) on REFUSE AND RECYCLING: STORAGE AND ACCESS REQUIREMENTS FOR NEW DEVELOPMENTS.
The compiled list of alternative sites is not considered sufficient to address Paragraph 121 Part C of the NPPF (2024) due to the limited number of alternative sites presented and the fact that the application site would also fall within the exclusions criteria underpinning the site selection, the proposal would not meet the bar of the Paragraph 121 of the NPPF (2024).
