The proposed two storey side extension, by reason of its siting and depth, would result in an unsympathetic and incongruous form of development that fails to preserve or enhance the character and appearance of the surrounding conservation area and host building of townscape merit. The scheme is therefore contrary to, in particular, policies 28, 29 & 30 of the Local Plan (2025), Supplementary Planning Document 'House Extensions and External Alterations' (2015) as supported by the St Margarets Conservation Area (CA19) Statement.
The development, by reason of the absence of an Arboricultural Impact Assessment, Tree Protection Plan (TPP) and Arboricultural Method Statement has failed to demonstrate that the proposal would not detrimentally impact on the health and longevity of nearby trees to the detriment of the visual amenity of the locality and the character and appearance of the area. The proposal is contrary to the NPPF and, in particular, policies 28 and 42 of the Local Plan.
By reason of its siting within areas of groundwater flooding and Flood Zone 2, and absence of a satisfactory Basement Screening Assessment/Basement Impact Assessment (as per the Basement Assessment User Guide), the application has failed to demonstrate that the proposed swimming pool will not increase or otherwise exacerbate flood risk on the site or beyond. The development is thereby contrary to the Local Plan policies 54 and 8, the Strategic Flood Risk Assessment (2021), Basement Assessment User Guide (2021) and the aims and objectives of the NPPF (2023).
The development, by reason of the absence of an adequate sustainable drainage strategy, has failed to demonstrate the development will not increase flood risk elsewhere. The scheme is contrary to the NPPF, London Plan policy SI12 and SI13, Local Plan policy 8, as supported by the Council's Strategic Flood Risk Assessment.
In the absence of a Preliminary Ecological Appraisal and Bat Roost Assessment, the scheme fails to demonstrate that habiats and species will not be adversely impacted, and thereby fails to comply with the aims and objectives of the NPPF and Development Plan policies, in particular, part IV of Circular 06/2005 and Local Plan policy 39.
