Decision & conditions

Refused Permission

Planning conditions
  1. This application has been refused as Insufficient information has been provided to justify the proposed felling of T1, a protected lime tree. The application states that the tree is causing damage due to encroachment, lifting of paving, and impacts on drainage and adjacent structures; however, no supporting evidence has been submitted to substantiate these claims. Furthermore, no structural or engineering evidence has been submitted to demonstrate that the tree is responsible for damage to built structures, including paving, drainage infrastructure, or the party wall. In the absence of such evidence, the Local Planning Authority is not satisfied that the removal of this tree is necessary or justified. As a result, the proposed works fail to meet the requirements for consent under the Tree Preservation Order, and the application is therefore refused.
  2. The applicant's attention is drawn to Section 78 of the Town and Country Planning Act 1990, by which an appeal may be made to the Secretary of State within 28 days of notification of this decision.
