In this instance: * The applicants did not seek formal pre-application advice, and the scheme was found to be contrary to policy and guidance, and subsequently refused. The Council is ready to enter into discussions, through the Council's formal pre-application service, to advise the applicants of relevant policy and guidance; and where possible assist in the preparation of a new planning permission. For the avoidance of doubt the Drawing(s) No(s) and Document(s) to which this decision refers are as follows: Location Plan, Existing Block Plan, Proposed Block Plan, ID-00, ID-01, ID-02, ID-03 & ID-05 received on 26 Mar 2026 and ID-04 received on 13 Apr 2026.
By reason of its siting, height, length, scale, bulk and design the proposed front garden outbuilding would result in a visually obtrusive, unsympathetic form of development which would be out of keeping with the development pattern of the area and would fail to relate to local character and appearance. The proposal fails to preserve the character, appearance and significance of the Conservation Area contrary to LP28 and LP29 of the Local Plan (2025) and the relevant sections of the NPPF Chapter 16, as supported by the CA6 Petersham Conservation Area Statement and Study.
The development, by reason of the absence of an Arboricultural Impact Assessment, Tree Protection Plan (TPP) and Arboricultural Method Statement has failed to demonstrate that the proposal would not detrimentally impact on the health and longevity of nearby statutory protected trees to the detriment of the visual amenity of the locality and the character and appearance of the CA6 Petersham conservation area. The proposal is contrary to the NPPF and, in particular, policies LP28 and LP42 of the Local Plan (2025).
