The development hereby permitted shall be begun no later than the expiration of three years from the date of this permission. Reason: In order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990.
The development hereby permitted shall be carried out in accordance with the following approved plans: PH-55MG-01, PH-55MG-02, PH-55MG-03, PH-55MG-04, PH-55MG-05, PH-55MG-06, PH-55MG-07, PH-55MG-08, PH-55MG-09, PH-55MG-10, Design and Access Statement, and Reasonable Exception Statement. Reason: In order to facilitate the use of section 73 of the Town and Country Planning Act 1990 to make minor material amendments to this planning permission.
The materials to be used in the construction of the external surfaces of the extension(s) hereby permitted shall match those used in the existing building. Reason: In order to ensure that the development has a satisfactory appearance and to comply with LP26 of the Council’s Local Plan.
The windows identified and annotated as such on drawing no. PH-55MG-07 listed under condition 2 above and located in the first floor north and south side elevations of the first floor extension hereby permitted shall be glazed in obscure glazing (of a Pilkington Level of no less than 3) and be non-openable up to a level of 1.7m above the internal floor level of the rooms they serve and shall be retained as such for life of the development unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the development complies with the terms of the application, in the interests of amenities of neighbouring properties and to comply with Policy LP30 of the Council’s Local Plan.
The use of the outbuilding as a hobby room/workshop/storeroom hereby permitted shall remain incidental and subservient to the primary use of the site/premises, and shall not become a separate or dominant use at any time. Reason: In order to prevent a separate use operating from this site, which may lead to an inappropriate and over intensive use of the site.
The dwelling house, as enlarged and/or altered in accordance with this permission, shall only be used as a single unit of accommodation, and shall not be subdivided, separated or altered in any way so as to create two or more separate units of accommodation, without further grant of planning permission. Reason: In order to prevent the creation, by conversion, of additional and inappropriate units of accommodation at this site, which may lead to an over intensive use of the site and to comply with Policies LP5 & LP23 of the Council’s Local Plan and Policy 6.13 of the London Plan.
Notwithstanding condition 2 above, before the development hereby permitted commences at the site, an Arboricultural Method Statement and Tree Protection Plan in accordance with the requirements of BS 5837 (2012) 'Trees in Relation to Design, Demolition and Construction' for all the trees located within the site and in proximity to 55, Malford Grove, London, E18 2DY, shall be submitted to and approved in writing by the Local Planning Authority. The protection measures as approved shall then be undertaken at the site before any work in connection with the development hereby permitted commences at the site, and shall be retained for the entire period of the duration of any work at the site, in connection with the development hereby permitted, within the fence or other means of enclosure surrounding the trees, no activities associated with building operations shall take place unless previously agreed in writing by the Local Planning Authority. Reason: In order to maintain the existing vegetation at the site, which makes an important contribution to the character of the area, and to accord with Policy LP38 of the Council’s Local Plan, Policy G7 of the London Plan, and Policy N2 of the NPPF 2026.
