Planning conditions

  2. Schedule 2 Part 1 Class B of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). Permission to use the dwellinghouse as a dwellinghouse was not granted only by virtue of Class M, N, P, or Q of Schedule 2 Part 3 (change of use) - Complies Must not exceed height of highest part of existing roof – Complies Must not extend beyond the plane of any existing roof slope which forms the principal elevation of the dwellinghouse and fronts a highway - Complies Maximum volume is 40m3 for terrace houses and 50 m3 in other cases - Does not comply for semi-detached house As shown below, aerial imagery from 1971 (and the planning history) indicates that the existing side extension is not original to the host dwelling. The GDPO Technical Guidance states that, "Any previous enlargement to the original roof space in any part of the house must be included in this volume allowance." As such, the side extension roof and dormer extension will be included in the volume calculation. Dormer (including existing dormer) - D x W x H/2 =m3 3.24 x 9.45 x 2.08 /2 = 31.8427 Hip to Gable - D x W x H/6 =m3 Proposed Hip to Gable - 8.58 x 4.35 x 2.80 /6 = 17.4174m3 Original Side Hip Roof Extension (hip to hip / slanted triangular prism where height is length of roofslope) = HxB/2xL = 4.291x4.291=3.08 = 34.69m3 Total volume - 32.874+ 17. 4174 + 34.69= 84.98m3 Must not involve installation, alteration or replacement of a veranda, balcony or raised platform, microwave antenna, chimney, flue or soil and vent pipe- Complies Must not be in a Conservation Area – Complies The materials used in any exterior work shall be of a similar appearance to those used in the construction of the exterior of the existing dwelling house – Complies Any window facing the side should be obscure glazed and non-opening up to 1.7 m above the floor – Complies The roof pitch should match the pitch of the original dwelling as far as practicable – Complies Other than in the case of a hip to gable enlargement, the edge of the enlargement closest to the eaves of the original roof shall, so far as is practicable, be not less than 20cm from the eaves of the original roof – Complies (1.10m from eaves) Overall Conclusion : Not Permitted
  3. Schedule 2 Part 1 Class C of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). Permission to use the dwellinghouse as a dwellinghouse was not granted only by virtue of Class M, N, P, or Q of Schedule 2 Part 3 (change of use) - Complies Does not protrude more than 0.15 metres beyond the plane of the slope of the original roof when measured from the perpendicular with the external surface of the original roof– Complies Must not be higher than the highest part of the original roof – Complies Must not include a chimney, flue or soil and vent pipe or solar photovoltaics or solar thermal equipment – Complies Any window facing the side should be obscure glazed and non-opening up to 1.7 metres above the floor of the room in which the window is installed- Complies Sensitively located if in Conservation Area - Not applicable/not in Conservation Area. Overall Conclusion: Permitted
  4. The proposal does not constitute permitted development, by virtue of Schedule 2 Article 3, Part 1, Class B of the Town and Country Planning (General Permitted Development) Order 2015.
