The use of the property known as 22 Northbrook Road, Ilford, IG1 3BS as a Large House in Multiple Occupation (HMO) (Sui Generis) is not lawful development within the period set out in Section 191 of the Town and Country Planning Act 1990 (as amended) as the available evidence to establish on the balance of probability that the property has been in continuous use as a Sui Generis HMO for a period of ten years prior to the submission of this application, with emphasis on the established connection to the neighbouring 24 Northbrook Rd Hotel; the submission's heavily reliance on statutory declarations; no HMO licence or other supplementary information provided to cover the period prior to 2021 and the counter indicative 2018 planning history of site hotel usage (retrospective permission sought).
