Planning conditions
  1. 3 YEAR CONSENT PERIOD: The development hereby permitted shall be begun not later than the expiration of three years from the date of this permission. REASON: To comply with the provisions of Section 91(1)(a) of the Town and Country Planning Act 1990 as amended by the Planning and Compulsory Purchase Act 2004 (Chapter 5).
  2. DRAWING AND DOCUMENT NUMBERS: The development hereby approved shall be carried out in accordance with the following approved plans: HR-2003-OSM V1; HR-2003-BP V1; HR-2003-PFP V1 Sheet 2/8; HR-2003-PFP V1 Sheet 4/8; HR-2003-E/PFE V1 Sheet 5/8; HR-2003-E/PRE V1 Sheet 6/8; HR-2003-E/PRSE V1 Sheet 7/8; HR-2003-E/PLSE V1 Sheet 8/8; Noise Impact Assessment Issue 01 prepared by DDA Group dated 25 March 2026; Odour Risk Assessment prepared by Se&Se Consultancy dated March 2026; Sustainable Design and Construction Statement; Design and Access Statement dated March 2026. REASON: To comply with Section 70(1)(a) of the Town and Country Act 1990 as amended and the Reason for Grant and also for the avoidance of doubt and in the interest of proper planning.
  3. MATERIALS (COMPLIANCE): The development shall be constructed in accordance with the schedule of materials noted on the approved plans and within the Design and Access Statement. The development shall be carried out strictly in accordance with the details so approved and shall be maintained as such thereafter. REASON: In the interest of securing sustainable development and to ensure that the resulting appearance and construction of the development is of a high standard.
  4. FIXED PLANT (COMPLIANCE): The design and installation of new items of fixed plant shall be such that when operating the cumulative noise level LAeq Tr arising from the proposed plant, measured or predicted at 1m from the facade of the nearest noise sensitive premises, shall be a rating level of at least 5dB(A) below the background noise level LAF90 Tbg. The measurement and/or prediction of the noise should be carried out in accordance with the methodology contained within BS 4142:2014+A1:2019. REASON: To ensure that the operation of fixed plant does not impact on residential amenity.
  5. NOISE REPORT (DETAILS): A report is to be commissioned by the applicant, using an appropriately experienced & competent person, to assess the noise from the proposed mechanical plant to demonstrate compliance with Condition 4. The report shall include site measurements of the plant in situ. The report shall be submitted to and approved in writing by the Local Planning Authority within three months of its installation. REASON: To ensure that the operation of fixed plant does not impact on residential amenity.
  6. FILTRATION CONDITION: Notwithstanding the plans hereby approved, the flue shall be fitted with fine filtration or Electrostatic Precipitation followed by carbon filtration (carbon filters rated with 0.4-0.8 second residence time) or alternatively fine filtration followed by carbon filtration and by counteractant/neutralising system to achieve the same level as above. The filter systems of the approved flue / extraction units shall be regularly maintained and cleaned; and any filters and parts requiring cleaning or replacement shall be easily accessible. REASON: To ensure that the operation of fixed plant does not impact on residential amenity.
  7. FIXED PLANT: You are advised that Islington have a duty to investigate any complaints in terms of statutory nuisance. It is advised that the plant is checked upon installation and regularly checked, maintained and serviced to ensure noise levels do not rise or acoustic character such as tonality, intermittency, impulsivity or other acoustic character develop.
  8. PLANT TIMER (COMPLIANCE): Prior to the hereby approved plant equipment being used, a timer shall be installed limiting the operation of the kitchen extraction system to between the hours of 08:00 to 23:00 each day only. The kitchen extraction system shall not be operated outside of these hours. The timer shall be maintained as such thereafter. REASON: In the interests of public health and amenity.
