EXTANT PERMISSION: The hereby approved residential dwellings shall not be occupied until practical completion has been obtained for the works approved under planning permission ref: P2025/2168/FUL dated 07/10/2025. REASON: To safeguard the residential amenity of future occupiers and ensure adequate natural daylight to comply with Class G.1(d)(iv) of the General Permitted Development Order (2015) as amended.
SOUND INSULATION AND NOISE CONTROL: The hereby approved residential dwellings shall not be occupied until full particulars and details of a scheme for sound insulation between the commercial uses and residential uses of the building is submitted to and approved in writing by the Local Planning Authority prior to superstructure works commencing on site. The sound insulation and noise control measures shall achieve the following internal noise targets: Bedrooms (23.00-07.00 hrs) 30 dB LAeq,8 hour and 45 dB Lmax (fast); Living Rooms (07.00-23.00 hrs) 35 dB LAeq, 16 hour; and Dining rooms (07.00 -23.00 hrs) 40 dB LAeq, 16 hour The details of the ventilation and any self-generated noise from the ventilation shall be included within the calculations with reference to the AVO Guidance. The sound insulation and noise control measures shall be carried out strictly in accordance with the details so approved, shall be implemented prior to the first occupation of the development hereby approved, shall be maintained as such thereafter and no change therefrom shall take place without the prior written consent of the Local Planning Authority. REASON: In the interests of protecting the amenity of future occupiers of the development and to comply with Class G.1 (d)(iii) of the General Permitted Development Order (2015) as amended.
The applicant is reminded of the following conditions as set out in Schedule 2, Part 3, Class G of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended): - In accordance with Schedule 2, Part 3, Paragraph W. Sub-paragraph (12) the development must be carried out — (a) where prior approval is required, in accordance with the details approved by the local planning authority; (b) where prior approval is not required, or where sub-paragraph (11)(c) applies, in accordance with the details provided in the application referred to in sub-paragraph (1), unless the local planning authority and the developer agree otherwise in writing. - In accordance with Schedule 2, Part 3, Class G.1 (c) the development permitted by Class G is subject to a flat must not be used otherwise than as a dwelling (whether or not as a sole or main residence)— (i)by a single person or by people living together as a family, or (ii)by not more than 6 residents living together as a single household (including a household where care is provided for residents).
For the avoidance of doubt, any required changes to the external elevations of the building, including fenestration, will require full planning permission.
The applicant is advised of the need to fully comply with Building Regulations 2010 in relation to fire safety compliance and noise insulation requirements.
